<br /> -3- <br /> It is further agreed that the minimum monthly rental rate set J::or <br /> the original term hereof will be increased twenty percent (20%) for the <br /> optional five year additional term provided for in paragraph 6. <br /> 8. RENT <br /> As rent for the premises, the LESSEE agrees to pay to the LESSOR <br /> at Post Office Box 666, San Marcos, Texas 78666, or at such other <br /> places as are mutually agreed upon the following amount(s): <br /> A. A minimum rental of Eleven Hundred and Seventy Five Dollars <br /> for the initial Five Year term hereof. <br /> The rent for each full calendar month, running from the first day <br /> of that month to the last day of that month, shall be paid, in advance, <br /> on or before the first (1st) day of that month. <br /> If the commencement date of the term of this lease shall be other <br /> than the first day of the calendar month, the rent for such partial <br /> month shall be calculated and prorated on the basis of a 30-day <br /> calendar month. <br /> 9. COMMENCEtvlENT DATE OF LEASE <br /> In order to establish the commencement date of this lease, as <br /> hereinabove referred to, LESSOR and LESSEE shall agree upon completion <br /> of construction as to the commencement date of the primary lease term, <br /> as set forth in paragraph 6. <br /> 10. TAXES <br /> All taxes assessed against the premises or taxes assessed in <br /> substitution thereof, and all mortgage payments or other charges <br /> required to discharge any lien or encumbrance that may affect the <br /> premises, and which is superior and prior to the terms of this lease <br /> and the rights of LESSEE hereunder, shall be paid by the LESSOR as the <br /> same shall become due. LESSEE agrees to pay all taxes assessed against <br /> property on the premises and owned by it. <br /> 11. USE <br /> LESSEE will use the leased premises for the following purposes: <br /> Performance of professional, administrative and clerical services <br /> by San Marcos, Texas Women's, Infants' and Children I s (WIC) Proj ect No. <br /> 36. <br /> 12. PUBLIC LIABILITY <br /> The LESSEE agrees to protect and save the LESSOR harmless from any <br /> and all claims of others for injuries to persons or property arising <br /> out of the occupancy or operation of the premises by the LESSEE and its <br /> sublessees, except such claims which arise out of negligent, <br /> intentional or willful acts of the LESSOR, or out of LESSOR'S failure <br /> to maintain the premises in accordance with paragraph 16 hereof <br /> (provided that if LESSEE has knowledge of the need for repairs, LESSEE <br /> must notify LESSOR thereof). <br /> LESSEE agrees to maintain, at its own expense, during the full <br /> term of this lease, a policy of public liability and property damage <br /> insurance issued by a reputable company authorized to do business in <br /> the State of Texas, in which policy LESSOR and LESSEE shall be named <br /> as co-insureds, and to furnish current certificates evidencing the <br /> existence of such insurance. Such policy shall provide coverage in an <br /> amount not less than $300,000.00 single limit combined bodily injury <br /> and property damage each occurrence, to cover all situations where any <br /> other person or persons claim personal inj ury, death, or property <br /> damage in or upon the premises. <br />
