<br /> 30 <br /> ORDINANCE 1984-112 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE <br /> CITY OF SAN MARCOS, TEXAS, AMENDING THE <br /> CODE OF ORDINANCES OF THE CITY OF SAN <br /> MARCOS, BY REPEALING CHAPTER 2 1/2, <br /> ALCOHOLIC BEVERAGES, AND AMENDING THE <br /> GENERAL ZONING ORDINANCE OF THE CITY OF <br /> SAN MARCOS BY AMENDING SECTION 30.B.2.; <br /> AND ADDING A SECTION 3l.B.2. AND 3.; BY <br /> DELETING SECTION 31.C.2. AND RENUMBERING <br /> THE REMAINING SUBSECTIONS IN NUMERICAL <br /> ORDER; AND AMENDING SECTION 35.H.3. BY <br /> DELETING THE PRESENT SECTION AND <br /> SUBSTITUTING REGULATIONS PERTAINING TO <br /> THE OPERATION OF ESTABLISHMENTS WHI CH <br /> DISPENSE LIQUOR, WINE AND BEER FOR <br /> ON-PREMISE CONSUMPTION; PROVIDING A <br /> PENALTY FOR VIOLATIONS OF SECTION <br /> 35.H.3.; AND ESTABLISHING AN EFFECTIVE <br /> DATE. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> SECTION 1. That Chapter 2 1/2, Alcoholic Beverages, of <br /> the Code of Ordinances of the City of San Marcos, Texas, Ordinance <br /> No. 1978-51, as amended is hereby repealed as of the effective <br /> date of this Ordinance as set out below. <br /> SECTION 2. That Section 30.B.2. of the General Zoning <br /> Ordinance of the City of San Marcos, Texas, be deleted and the <br /> following be substituted therefor: <br /> Section 30. C Commercia1 District. <br /> . .. <br /> B. Specific Uses (requires a Specific Use Permit in <br /> accordance with Section 35): <br /> . .. <br /> 2. Establishments which dispense liquor, wine, or beer for <br /> on-premise consumption under permit by the State of <br /> Texas. <br /> SECTION 3. Tha t the following parts 2 and 3 be added to <br /> Section 31.B. of the General Zoning Ordinance of the City of San <br /> Marcos, Texas: <br /> Section 31. CBA Central Business Area. <br /> . .. <br /> B. Specific Uses: <br /> . .. <br /> 2. The total number of establishments dispensing alcoholic <br /> beverages for on-premise consumption shall be limited to <br /> fifteen (15). <br />
