<br /> -2- <br /> 3. Mixed use buildings of O-P, C, and residential uses. <br /> SECTION 4. That Section 31.C.2. of the General Zoning <br /> Ordinance of the City of San Marcos, Texas, be deleted and the <br /> remaining subsections be renumbered in numerical order. <br /> SECTION 5. Tha-t Subsection 3 of Section 35.H. of the <br /> General Zoning Ordinance of the City of San Marcos, Texas, be <br /> deleted and the following be substituted therefor: <br /> Section 35. Specific Use Permits. <br /> . .. <br /> H. Conditions of Specific Use: <br /> . . . <br /> 3. Establishments dispensing liquor for on-premise <br /> consumption. (To be called a TABC specific use permit) <br /> a. Procedures: <br /> ( 1) Applicant shall complete and submit an <br /> application form to be provided by the City of San <br /> Marcos Planning Director. <br /> ( 2) The Planning Director shall review the <br /> application form and site plan in accordance with <br /> Section 35.D for completeness and place the <br /> application on the Zoning Commission calendar for <br /> its consideration and notify all land owners within <br /> 200 feet of the si te . <br /> ( 3) The Zoning Commission shall hold a public <br /> hearing when considering an application for a TABC <br /> specific use permit. <br /> (4) The Zoning Commission shall act on -the <br /> application within 30 days of the submission of <br /> the application to the Director of Planning, except <br /> upon a showing of good cause. When a permi-t is <br /> authorized by the Zoning Commission, it shall be <br /> issued by the Planning Director only after a TABC <br /> license is issued -to the permittee. <br /> b. Standards: <br /> For the specific use permit to be initially issued <br /> or an existing permit to be renewed or allowed to <br /> continue, the following standards will be me"t <br /> (Figures in parentheses at the end of each section <br /> are weighted values to be used in the Review, <br /> Revocation or Supervision process in 35.H.3.f.): <br /> ( 1) Location relative to existing land uses. <br /> (a) The place of said business is not located <br /> within three hundred (300) feet of a residence <br /> located within a zoning district allowing a <br /> density of six (6) units per acre or less. No <br /> person shall sell or engage in the business of <br /> selling any alcoholic beverages for on-premise <br /> consumption where the place of business is <br /> located within three hundred (300) feet of a <br /> church, public school, or public hospital. <br />
