The City Council shall. upon conclusion of ~ public <br />hearinq on the matter~ have final authority to approve <br />or disapprove of the Commissions' recommendation. <br />Procedures for Council action shall be the same as <br /> <br />- ------ <br /> <br />set forth in Section 1.5.7.7 of the Land Development <br />Code. <br /> <br />SECTION 2. The following subsections of 4.3.4.2(c) are to be renumbered as <br />follows: <br /> <br />(~ ~) Issuance to the holder.... <br />(4.Q) Suspension. In accordance... <br />(b Q) Revocation. <br />(9 Z) Administrative approvaL.. <br />(7-~) Limitations in the CBA District... <br /> <br />SECTION 3. Unless the City Council takes contrary action, this ordinance will <br />expire one year from the date of enactment. <br /> <br />SECTION 4. If any word, phrase, clause, sentence, or paragraph of this <br />ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, <br />the other provisions of this ordinance will continue in force if they can be given effect <br />without the invalid portion. <br /> <br />SECTION 5. All ordinances and resolution or parts of ordinances or resolutions <br />in conflict with this ordinance are repealed. <br /> <br />SECTION 6. Any person violating any provision of this ordinance commits a <br />misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos <br />City Code upon conviction. <br /> <br />SECTION 7. This Ordinance will take effect 10 days after the date of its final <br />passage, and the City Clerk will publish notice of its adoption in a newspaper of general <br />circulation in the City. <br /> <br />PASSED AND APPROVED on first reading on August 6,2007 <br /> <br />PASSED AND APPROVED on second reading on August 21,2007. <br />
