<br />by a public authority. Landlord reserves the right to change from time to time the dimensions and location of the
<br />Common Area, as well as the dimensions, identity and type of any buildings in the Shopping Center, and to
<br />construct additional buildings or additional stories on existing buildings or other improvements in the Shopping
<br />Center, including, but not limited to freestanding buildings or kiosks. Tenant, and its employees and customers, and
<br />when duly authorized pursuant to the provisions of this Lease, its Subtenants, licensees and concessionaires, shall
<br />have the non-exclusive right to use the Common Area as constituted from time to time, such use to be in common
<br />with Landlord, other Tenants to the Shopping Center and other persons permitted by Landlord to use the same, and
<br />subject to such reasonable rules and regulations governing use as Landlord may from time to time prescribe,
<br />including the designation of specific areas within the Shopping Center or in reasonable proximity thereto in which
<br />automobiles owned by Tenant, its employees, Subtenants, licensees and concessionaires shall be parked, In this
<br />regard, Tenant shall furnish to Landlord upon request a complete list of license numbers of all automobiles operated
<br />by Tenant, its employees, Subtenants, licensees or concessionaires, and Tenant agrees that if any automobile or other
<br />vehicles owned by Tenant or any of its employees, Subtenants, licensees or concessionaires shall at any time be
<br />parked in any part of the Shopping Center other than the specified areas designated for employee parking, Tenant
<br />shall pay to Landlord as additional rent upon demand an amount equal to the daily rate or charge for such parking as
<br />established by Landlord from time to time for each day, or part thereof, such automobile or other vehicle is so
<br />parked. Tenant shall not solicit business or display merchandise within the Common Area, or distribute handbills
<br />therein, or take any action which would interfere with the rights of other persons to use the Common Area. Landlord
<br />may temporarily close any part of the Common Area for such periods of time as may be reasonably necessary to
<br />prevent the public from obtaining prescriptive rights or to make repairs or alterations. Landlord reserves the right to
<br />grant to third persons the non-exclusive right to crossover and use in common with Landlord and all Tenants ofthe
<br />Shopping Center the Common Area as designated from time to time by Landlord. Landlord shall have the right to
<br />make changes to the Common Area, including, without limitation, changes in the location or configuration of
<br />driveways, entrances, exits, vehicular parking spaces, parking area or the direction of the flow of traffic.

<br />Section 5.2. Parking Area. Landlord may from time to time substitute for any parking area other areas
<br />reasonably accessible to the Tenants ofthe Shopping Center, which areas may be elevated, surface or underground.
<br />Tenant will not load or unload any trucks or permit any trucks serving the Demised Premises, whether owned by
<br />Tenant or not, to be loaded, unloaded, or parked in the Shopping Center, except in the areas specifically designated
<br />for such use by Landlord.

<br />Section 5.3. Management of Common Area. Landlord shall be responsible for the management, and
<br />maintenance of the Common Area, the manner of maintenance and the expenditures therefore to be in the sole
<br />discretion of Landlord. Landlord shall have the right to select a person to maintain and operate any of the Common
<br />Area if at any time Landlord determines that the best interests of the Shopping Center will be served by having any
<br />of the Common Area maintained and operated by that person. Landlord shall have the right to negotiate and enter
<br />into a contract with that person on such terms and conditions and for such period of time as Landlord deems
<br />reasonable and proper, both as to services and as to cost.

<br />Section 5.4. Common Area Costs. In addition to rentals, Tenant shall pay to Landlord, in accordance with the
<br />above Section 1.1(1) Tenant's proportionate share of the Common Area Costs (as hereinafter defined). "Common
<br />Area Costs" means the real property taxes and assessments and other taxes and assessments of any nature levied and
<br />assessed against the Common Areas, or assessed against Landlord as a result of the Common Areas and all sums
<br />expended by Landlord for maintenance, management and operation of the Common Areas. Among, but not limited
<br />to, the costs to be included in Tenant's share of the actual costs of Common Area Maintenance are the following:
<br />painting, roof leaks, common area lighting, municipal or local fire protection or hydrant charges, parking lot
<br />cleaning, sewer and water charges, insurance, installation and removal of community projects, exterminating,
<br />maintenance and repair of parking areas, sidewalks, and areas common to all occupants of the Shopping Center,
