On or before June 1, 1983, the City shall convey <br /> to SWT by General Warranty Deed, a tract located on the southeast <br /> corner of the intersection of Sessoms Drive and Comanche Street <br /> In San Marcos, Hays County, Texas, consisting of approximately <br /> .23 acres, which tract is more fully described by metes and bounds <br /> in Attachment "B", attached hereto and incorporated herein by <br /> reference for all purposes. This conveyance is also contingent <br /> upon the City's construction of the drainage ditch which is subject <br /> d:: <br /> of paragraph 1. 02 and if the ditch is not construed as provided <br /> '" <br /> therein, title to this property will remain in the City. <br /> 3. Right-of-Way and License <br /> 3.01. SWT hereby grants to the City a non-exclusive <br /> right-of-way easement for pedestrian and vehicular traffic on <br /> and across SWT property for access to the city park adjacent to <br /> said SWT property, which right-of-way is more fully described by <br /> metes and bounds in Attachment "C", attached hereto and incorporated <br /> herein by reference for all purposes. This easement shall exist <br /> for a period of 99 years from the date of this agreement.
