<br />80 <br /> <br /> <br /> <br /> <br />Regular Meeting June 24, 1985 Page 6 <br /> <br /> <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING ORDINANCE 1984-88 ADOPTED <br />SEPTEMBER 24, 1984 WHICH ADDED A SUBSECTION D TO <br />SECTION IV OF THE MASTER PLAN, TO CHANGE SAID <br />SUBSECTION D TO SUBSECTION C; TO AMEND SUBSECTION <br />3 OF SAID SUBSECTION C, IMPLEMENTING THE LAND <br />USE ELEMENT OF THE MASTER PLAN, OF SECTION IV, <br />LAND USE, OF SAID MASTER PLAN BY DELINEATING THE <br />RESPONSIBILITIES OF THE PLANNING COMMISSION, THE <br />ZONING COMMISSION AND THE CITY COUNCIL AND PRO- <br />VIDING FOR MAP AMENDMENTS BY RESOLUTION OF THE <br />CITY COUNCIL ONLY AFTER A PUBLIC HEARING; TO <br />DELETE FROM SAID SECTION IV, SUBSECTION C, THE <br />SUMMARY FOLLOWING SAID SUBSECTION C.3; AND DE- <br />CLARING AN EFFECTIVE DATE. <br /> <br />Mr. Farr moved for adoption of the Ordinance on third and final <br />reading and Mr. Coddington seconded the motion. Mayor Craddock <br />voiced objection to Master Plan amendments being made by Resolu- <br />tion and stated that at the time the Master Plan was adopted, <br />the Council adopted it by Ordinance and not by Resolution. Mayor <br />Craddock stated that the adoption of this Ordinance would change <br />that procedure. Mr. Robbins discussed the history behind the <br />Ordinance. He stated that in September the process by which <br />the Land Use Map or Future Land Use Map (Plan) was to be amended <br />was discussed in detail, and that at that time the Council decided <br />that it would only review those land use amendments that had to <br />do with zoning cases. Mr. Robbins stated that amending the <br />Master Plan by Resolution instead of by Ordinance would not weaken <br />in any manner the Master Plan because the policies of the Master <br />Plan would still be used by the decision-making bodies. Mr. <br />Coddington stated that the proposed Ordinance would speed up the <br />process of land use amendments but voiced concern about enforce- <br />ability and any legal lssues that might arise. Mr. Robbins <br />stated that the proposed Ordinance would simply set a procedure <br />by which amendments can be made to a tool to ensure that the <br />community is physically developed in accordance with the policies <br />of the Master Plan which are graphically displayed in a general <br />sense on the Land Use Map. Mr. Robbins further stated that the <br />proposed Ordinance would not change the thrust of the Plan but <br />would set forth procedures on how to use the Land Use Map in the <br />process of moving the existing use of land, the zoning of the <br />land, and the Land Use Map together into one. He stated that <br />the Land Use Map would be used as a tool in that decision-making <br />process and that nothing would be gained in extending the amend- <br />ment process to another three or four months because it is unlikely <br />that any additional information would be brought to the Council <br />during that extended time period. Mr. Farr stated that a zoning <br />designation alters the Land Use Map but an alteration of the Land <br />Use Map does not alter the zoning designation. Mr. Robbins stated <br />that zoning does not change the Land Use Map and that nothing <br />could change the Land Use Map except by Resolution of the Council, <br />as proposed in the Ordinance. Mr. Farr stated that zoning desig- <br />nations are achieved by Ordinance. The City Manager stated that <br />zoning changes that are not in conformance with the Land Use Map <br />would have to include Land Use amendments along with them. <br />Mr. Farr stated that in that case a person would have to wait <br />for three readings to get the zoning designation and if land <br />use amendments are done by Ordinance also, the zoning designation <br />and land use amendment would be achieved at the same time. The <br />City Manager stated that in those instances, the land use amendment <br />would be attained when the zoning designation is attained. He <br />further stated that in the 1970's plat approval did not even come <br />to the City Council but those decisions were made by the Planning <br />Commission and actually changed the land use element. The City <br />Manager stated that the only thing being changed by the proposed <br />Ordinance, in order to be in compliance with the City Charter, <br />is that the City Council take official action.
