82 Regular Meeting June 24, 1985 Page 8 Mayor Craddock introduced for consideration adoption of a Resolu- tion, the caption of which was read as follows: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS AUTHORIZING AND APPROVING THE TERMS AND CONDITIONS OF A PROPOSED AGREEMENT BETWEEN MELISSA MILLECAM AND SAID CITY FOR THE PROVISION OF PUBLIC INFORMATION SERVICES; AUTHORIZING THE CITY MANAGER TO EXECUTE SAID AGREE}1ENT; AND DECLARING AN EFFECTIVE DATE. Mr. Coddington moved for adoption of the Resolution and Mr. Guerra seconded the motion. On roll call the following vote was recorded: AYE: Coddington, Craddock, Guerra, Nicola. NAY: None. ABSTAIN: Farr. Mayor Craddock introduced for consideration adoption of a Resolu- tion, the caption of which was read as follows: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, TERMINATING THAT CERTAIN CONTRACT BE- TWEEN COMMUNITY LAND RESOURCES, INC. AND SAID CITY DATED MAY 21, 1985; APPROVING THE TERMS AND CONDI- TIONS OF A PROPOSED CONTRACT WITH KENT S. BUTLER AND LEWIS F. MCLAIN FOR THE PROVISION TO SAID CITY OF PLANNING AND MANAGEMENT SERVICES IN CONNECTION WITH THE REVIEW AND NEGOTIATION OF MUNICIPAL UTILITY DIS- TRICT PROPOSALS¡ AUTHORIZING THE CITY MANAGER TO EXECUTE SAID CONTRACT AND ANY AND ALL OTHER DOCU- MENTS AND INSTRUMENTS INCIDENT TO THE PURPOSES OF SAID CONTRACT; AND DECLARING AN EFFECTIVE DATE. Mayor Craddock moved for adoption of the Resolution and Mr. Farr seconded the motion. Mr. Coddington inquired about the difference between the contract proposed for termination and the new contract. The City Attorney explained that the new contract would be sub- stituted for the other contract, eliminating at least one unneces- sary person and saving the City money. He further stated that Mr. Butler is not a partner in Community Land Resources, Inc. and that one of Community Land Resources, Inc.'s policies is that one of its partners has to always be on site wherever they are working. The Council then voted unanimously for adop- tion of the Resolution. Mayor Craddock introduced for consideration approval of archaeological excavation by Southwest Texas State University at four sites located along the San Marcos River within the City parks. Mr. Farr moved for approval and Mr. Coddington seconded the motion. Mr. Nicola inquired as to the locations of the proposed excavations. Mr. Cod- dington inquired as to the amount of interference with park traffic tllat the excavations would cause and the condition in which the park would be left after completion of excavation. Jim Garber, Assis- tant Professor from Southwest Texas State University, then addressed the Council. Mr. Garber informed the Council that the specific loca- tions of the excavation sites could be publicly disclosed but might result in subsequent illegal excations. He stated that the sites are located along the San Marcos River. Mr. Nicola stated that he thought it was appropriate for Council to receive the information somehow. Mr. Coddington expressed the same opinion. Mr. Farr asked if any portion of park trails or routes would be blocked by the excavations. Mr. Garber stated that they would not be blocked. In response to a question by Mayor Craddock, Mr. Garber stated the excavations would meet all State and Federal guidelines with respect to archaeological excavations. Mr. Garber stated that the size of the excavations would depend mostly on the discoveries. Mr. Garber stated that the
