<br /> -3- <br /> that any other parties may have use thereof. It is understood <br /> and agreed by and between Lessor and Lessee that the continuing <br /> use of said Airport as an airport for general aviation is essential <br /> to the operation of Lessee and that the failure to continue the <br /> use of said Airport for airport and aviation purposes shall <br /> constitute a default in the Agree~ent. Upon Lessee giving written <br /> notice of such default to Lessor and upon the failure of Lessor <br /> to cure such default within thirty (30) days after the receipt <br /> of said written notice, this Agreement shall terminate and end as <br /> of the date one hundred and twenty (120) days after the receipt <br /> of said written notice. Lessee shall thereupon be released from <br /> and relieved of alL further obligations thereafter to accrue <br /> hereunder. <br /> VIII. <br /> Maintenance of the runways, taxiways, entrance roads, <br /> driveways and existing parking lots leading to and/or contiguous <br /> to the demised premises, and unoccupied property of said Airport, <br /> except for the demised premises shown on Exhibit A of this Agreement, <br /> shall remain the obligation of Lessor; provided, however, that <br /> Lessor shall only be obligated to use airport revenue funds for <br /> such purposes and that Lessor shall never have the obligation to <br /> use general, operating or bond funds for the purpose of said <br /> maintenance. <br /> IX. <br /> Lessor agrees that all airport revenue derived from <br /> Lessee should be allocated toward the maintenance and improvement <br /> of said Airport; provided, however, that this requirement shall <br /> not be construed as mandatory upon Lessor unless so required by <br /> existing indenture or agreement with the United states of America <br /> or any amended or substitute indentures and agreements hereinafter <br /> entered into with the United States of America. <br /> X. <br /> Lessor represents and warrants that Lessor has full right <br /> and lawful authority to enter into and perform Lessor's obligations <br /> under this Agreement for the full term of this Agreement and has <br />
