"Premises ") of the Primary Lease Premises consisting of a hangar located at 2194 <br />Airport Drive, San Marcos, Texas 78666. <br />2. Term, Surrender. <br />A. Term. The term ( "Term ") of this Sublease is one (1) year, <br />commencing on April 1, 2014 (the "Sublease Commencement Date ") and ending at <br />11:59 p.m. (Austin, Texas time) on March 31, 2015 (the "Expiration Date "), or at such <br />earlier date as this Sublease may be terminated pursuant to the terms of this Sublease. <br />The preceding sentence notwithstanding, this Sublease will automatically terminate <br />upon the expiration or termination for any reason of the Primary Lease. <br />B. End of Term. Upon the expiration or termination of this Sublease, <br />Sublessee must: (i) surrender to Sublessor any keys, electronic ID cards, and other <br />access devices to the Premises at the place then fixed hereunder for payment of rent <br />and other charges hereunder to Sublessor; (ii) remove all of Sublessee's trade fixtures <br />and other personal property from the Premises; (iii) surrender the Premises in "broom <br />clean" condition and in compliance with the terms and conditions of the Primary Lease <br />pertaining to surrender of the Premises; (iv) except for reasonable wear and tear <br />resulting from normal use, surrender the Premises and fixtures in the same condition in <br />which Sublessee received them; and (v) deliver the Premises to Sublessor free and <br />clear of any and all hazardous materials and substances so that the condition of the <br />Premises conforms at such time with all applicable environmental laws, ordinances, <br />rules and regulations. <br />3. Sublease Rent. For the Term, Sublessee must pay to Sublessor as base <br />rent (the "Sublease Rent") for the Premises the sum of $18,000. The Sublease Rent <br />must be paid in monthly rent payments of $1,500.00 each in advance at least five (5) <br />days prior to the first day of each calendar month during the Term, except that the first <br />such payment shall be due on March 31, 2014. All payments must be in the form of a <br />check unless otherwise agreed by Sublessor, except that payment by check will not be <br />deemed made if the check is not duly honored with good funds. If any such check is <br />ever returned for lack of sufficient funds or is otherwise not duly honored with good <br />funds, then Sublessor may thereafter require, upon written notice thereof to Sublessee, <br />that all future payments of Sublease Rent or other charges under this Sublease be <br />made in cash or cash equivalent mode. If the Term commences or ends at any time <br />other than the first day of the month, then Sublease Rent will be prorated for such <br />month. <br />4. Additional Rent. In addition to the Sublease Rent provided in Section 3, <br />Sublessee must also reimburse to Sublessor all such other sums of money becoming <br />due and payable by Sublessor to Landlord or any other third party under the Primary <br />Lease and relating to the Premises, including, without limitation, Sublessee's Share of <br />operating expenses, common area expenses, taxes and un- metered utilities for the <br />Primary Lease Premises ( "Additional Rent"). The Additional Rent shall also include <br />the amount of (i) any portion of the tax imposed on Landlord attributable to the gross <br />receipts of the Premises and /or rents received therefrom or a franchise tax, <br />2 <br />12osW <br />f <br />
