<br /> -2- <br /> III. <br /> Rent for said ground space shall be paid to the City of <br /> San Marcos, Texas, Department of Finance, 630 East Hopkins, <br /> San l-iarcos, Texas, 78666. Payment shall be due on the date <br /> of execution of this Agreement by Lessee. Succeeding payments <br /> shall be due on the same day of subsequent months. <br /> IV. <br /> Lessee agrees to indemnify and hold harmless Lessor from <br /> all damages, claims, losses, demands, suits, judgments, costs <br /> and expenses arising from the use of said ground space to secure <br /> an airplane and shall defend any litigation arising in connection <br /> with said use, including reasonable attorney's fees, whenever <br /> said damages, claims, losses, demands, suits, judgments, costs <br /> or expenses are caused in whole or in part by any negligent act <br /> or omission of Lessee, anyone directly or indirectly employed <br /> by Lessee or anyone for whose acts Lessee may be liable, regard- <br /> less of whether said damages, claims, losses, demands, suits, <br /> judgments, costs or expenses are caused in part by Lessor. <br /> V. <br /> Lessee shall occupy said ground space at its own risk, and <br /> releases Lessor, to the full extent permitted by law, from all <br /> claims of every kind resulting in loss of life, personal or bodily <br /> injury or property damage. <br /> VI. <br /> This agreement shall be subject to: <br /> A. Any existing or future federal or state statutes or any <br /> existing or future lease or agreement between Lessor and the. <br /> United States or the State of Texas relative to the development, <br /> construction, operation, or maintenance of the airport, the execu- <br /> tion of which has been or may be required as a condition precedent <br /> to the expenditure of federal or state funds for the development, <br /> construction, operation or maintenance of said airport. <br /> B. Other existing agreements and leases between Lessor and <br /> the United States and any and all future releases, deed s, leases <br />
