-2- III. Rent for said ground space shall be paid to the City of San Marcos, Texas, Department of Finance, 630 East Hopkins, San l-iarcos, Texas, 78666. Payment shall be due on the date of execution of this Agreement by Lessee. Succeeding payments shall be due on the same day of subsequent months. IV. Lessee agrees to indemnify and hold harmless Lessor from all damages, claims, losses, demands, suits, judgments, costs and expenses arising from the use of said ground space to secure an airplane and shall defend any litigation arising in connection with said use, including reasonable attorney's fees, whenever said damages, claims, losses, demands, suits, judgments, costs or expenses are caused in whole or in part by any negligent act or omission of Lessee, anyone directly or indirectly employed by Lessee or anyone for whose acts Lessee may be liable, regard- less of whether said damages, claims, losses, demands, suits, judgments, costs or expenses are caused in part by Lessor. V. Lessee shall occupy said ground space at its own risk, and releases Lessor, to the full extent permitted by law, from all claims of every kind resulting in loss of life, personal or bodily injury or property damage. VI. This agreement shall be subject to: A. Any existing or future federal or state statutes or any existing or future lease or agreement between Lessor and the. United States or the State of Texas relative to the development, construction, operation, or maintenance of the airport, the execu- tion of which has been or may be required as a condition precedent to the expenditure of federal or state funds for the development, construction, operation or maintenance of said airport.
