-3- and agreements hereafter granted or entered into by and between the united states and the City of San Marcos with reference to the conveyance by the United states to the City of San Marcos of any real or personal property under any existing or future federal statutes authorizing the conveyance of such property by the federal government to the City for airport purposes. C. The right of Lessor to further develop, improve, main- tain, modify and repair the landing area, the terminal buildings and other buildings and appurtenances on the airport, as it so sees fit, regardless of the desires or view of the Lessee and without interference of hindrance by the Lessee. VII. Lessee agrees to abide by such rules as may be established from time to time by Lessor covering the use of said ground space to secure an airplane. VIII. Lessee warrants that Lessee has inspected the condition of the tie-down facilities and is satisfied with and accepts same in their present condition. Lessee hereby agrees to inspect the condition of the tie-down facilities on a regular basis and to notify promptly in writing the Airport Liaison Officer of Lessor of any defect noted. IX. It is hereby agreed that Lessee shall have total responsibility for the parking and securing of the airplane. Lessee shall retain the key to said airplane. Lessor shall have no responsibility at any time to move said airplane. X. It is mutually understood and agreed that nothing contained in this Agreement is intended, or shall be construed, as in any wise creating or establishing the relationship of co-partners or joint venturers between the parties hereto or as constituting the Lessee as the agent or representative of the Lessor for any purpose or in any manner whatsoever.
