<br /> and from which an iron stake found at the base <br /> of a corner fence post bears, S 45° 15' E, 1. 90 <br /> feet; <br /> THENCE, leaving the said Missouri and Pacific <br /> Railroad Right of Way, with fence, the South- <br /> west line of the said Donalson tract, the <br /> following courses numbered (5) through ( 8) : <br /> (5) N 45° 15' W, at 20 feet passing the <br /> aforementioned Northwest line of the <br /> said Southwestern Bell Telephone Co. <br /> 20 foot Easement and continuing on <br /> in all 877.28 feet to a fence post; <br /> (6) N 44° 49' W, 543.33 feet to a fence <br /> post; <br /> (7) N 45° 13' W, 281.27 feet to a fence <br /> post in a rock wall; <br /> (8) N 45° 57' W, at about 225 feet passing <br /> a 14 inch Elm tree, leaving the said rock wall <br /> and continuing on with fence, 252.0l feet to the <br /> remains of a concrete encasement for a corner <br /> fence post on the arc of a curve to the right on <br /> the aforementioned Southeast line of the said <br /> R.M. Highway No. 2439, for the West corner of <br /> the tract herein described; <br /> THENCE, with the Southeast line of the said R.M. <br /> Highway No. 2439, the following courses numbered <br /> (9) and (10): <br /> ( 9) 355.41 feet along the arc of the said <br /> curve to the right, having a radius of <br /> 1105.92 feet and a sub-chord which bears <br /> N 34° 27' E, 353.88 feet to a concrete <br /> monument found at the POINT OF TANGENCY; <br /> (10) N 43° 39' E, at 1128.58 feet passing a <br /> concrete monument found and continuing on in all, <br /> 1311.72 feet to the POINT OF BEGINNING containing <br /> 78.23 acres of land. <br /> WHEREAS, notices of said public hearings were published in <br /> the San Marcos Daily Record, a newspaper having general circulation <br /> in said city and in the territory proposed for annexation, on <br /> April 24, 1983, and April 26, 1983 , respectively, said dates <br /> being not more than twenty (20) days nor less than ten (10) days <br /> prior to the hearing for which notice was given; and, <br /> WHEREAS, prior to the publication of notice of said hearings, <br /> the City Council of the City of San Marcos, Texas, directed prepara- <br /> tion of a service plan that provides for the extension of municipal <br /> services to said area proposed for annexation; and, <br /> WHEREAS, said proposed service plan was made available for <br /> inspection and explained to the inhabitants of the area to be <br /> annexed at said public hearings; and, <br /> WHEREAS, said 78.23 acres are located within the extraterrito- <br /> rial jurisdiction of the City of San Marcos, Texas, and not within <br /> the extraterritorial jurisdiction of any other city; and, <br /> WHEREAS, said 78.23 acres are contiguous and adjacent to <br /> the current boundaries of the City of San Marcos, Texas; now, <br /> therefore, <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br />
