<br /> shall be sent to all owners of property, <br /> or to the person rendering the property <br /> for city taxes, affected by such proposed <br /> changes in classifications and to all <br /> owners of property, or to the person <br /> rendering the property for city taxes, 10- <br /> cated within two hundred (200) feet of <br /> any property affected thereby within not <br /> less than ten (10) days before any such <br /> hearing is held. Such notice may be served <br /> by depositing the same, properly addressed <br /> and postage-paid, in the city post office. <br /> Where property lying within two hundred <br /> (200) feet of the property proposed to be <br /> changed is located in territory which was <br /> annexed to the City after the final date <br /> of making the renditions which are included <br /> on the last approved city tax roll, notice <br /> to such owners shall be given by publica- <br /> tion in the manner provided by [this] para- <br /> graph 3. <br /> B. Public hearings: After receipt of the final <br /> report from the Zoning Commission, a public <br /> hearing shall be held by the City Council be- <br /> fore adopting any proposed amendment, supple- <br /> ment or change. Notice of such hearing shall <br /> be given by publication one time in a newspaper <br /> of general circulation in the City of San Marcos <br /> stating the time and place of such hearing, <br /> which time shall be not less than fifteen (15) <br /> days nor more than twenty (20) days from the date <br /> of publication. <br /> C. Joint meetings: In cases where the City Council <br /> deems it feasible and practicable to do so, public <br /> hearings provided for herein to be held before the <br /> Zoning Commission and the City Council, respectively, <br /> may be held jointly before the Commission and Council, <br /> and the City Council shall not take final action <br /> until it has received the final report of the Zoning <br /> Commission. <br /> D. Protests and recommendations for denial: <br /> 1. In case of a written protest against any <br /> change in zoning, signed by the owners <br /> of twenty (20) per cent or more either of <br /> the area of the lots or land included in <br /> such proposed change, or of the lots or <br /> land immediately adjoining the same and <br /> extending two hundred (200) feet therefrom, <br /> such amendment shall not become effective <br /> except by the favorable vote of three- <br /> fourths of all the members of the legislative <br /> body of the City of San Marcos. <br /> 2. A vote of three-fourths of all the members <br /> of the legislative body of the City of San <br /> Marcos is also required to overrule a recommenda- <br /> tion of the Zoning Commission that the pro- <br /> posed amendment, supplement or change be denied. <br /> E. Appeals for specific use permits: Any person or <br /> persons, jointly or severally, aggrieved by any <br /> decision of the Zoning Commission, may present to <br /> the City Council a statement, duly verified, setting <br /> forth that such decision is unjust, in whole or <br /> in part, specifying the grounds of injustice.
