<br /> -4- <br /> XII. <br /> During the time of war or national emergency, City shall have <br /> the right to lease the landing area, airport or any part thereof to <br /> the united states Government for military or naval use, and if such <br /> lease is executed, the provisions of this instrument insofar as they <br /> are inconsistent with the provisions of the lease to the Government, <br /> shall be suspended. The lease shall be subordinate to the provisions <br /> of any existing or future agreement between City and the United States, <br /> relative to the operation of maintenance of the airport, the execution <br /> of which has been or may be required as a condition precedent to the <br /> expenditure of Federal funds for the development of the airport. <br /> XIII. <br /> City agrees to waive its right to object to an assignment or <br /> transfer of rights and privileges by Agricultural Lessee to C.A.F. <br /> for the period of time described in Part I under the terms of the <br /> agricultural lease agreement entered into by City and Agricultural <br /> Lessee on October 12, 1982. C.A.F. shall agree in writing to abide <br /> by and accept all the provisions of said lease agreement between <br /> City and Agricultural Lessee. <br /> XIV. <br /> The City of San Marcos Airport Commission shall approve all <br /> facilities and utilities to be installed by C.A.F. <br /> XV. <br /> It is specifically understood and agreed that nothing contained <br /> herein shall be construed as a granting or authorizing the granting <br /> of an exclusive right for exercising of an aeronautical activity, <br /> nor to conduct any activity which is discriminatory and C.A.F. <br /> specifically agrees to operate a non-discriminatory operation. <br /> XVI. <br /> If C.A.F. fails to pay any rental or other payment due hereunder <br /> or upon its failure to perform any other of the terms of this lease <br /> to be observed or performed by C.A.F., or if C.A.F. shall become a <br /> bankrupt, or insolvent, or file any debt or proceedings, or take or <br /> have taken against C.A.F. in any court pursuant to any statute either <br /> of the united States or of the State of Texas a petition in bankruptcy <br />
