<br /> -5- <br /> or insolvency or for reorganization or for the appointment of a <br /> receiver or trustee for all or a portion of C.A.F.'s property, <br /> or if C.A.F. makes an assignment for the benefit of creditors, <br /> or petitions for or enters into an agreement or suffers this <br /> lease to be taken under any writ of execution or attachment, or <br /> if this lease shall pass to or dissolve upon by law or otherwise, <br /> one other than C.A.F. except as herein provided, then in anyone or <br /> more such events, upon City serving thirty (30) days written notice of <br /> cancellation upon C.A.F. specifying the nature of said default and if, <br /> at the expiration of said thirty (30) days, C.A.F. shall have failed <br /> to comply with or remedy such default, then this lease and the term <br /> thereunder, shall at the option of the city, terminate and come to <br /> an end on the date specified in such notice of cancellation, and C.A.F. <br /> shall quit and surrender the demised premises to city as if the term <br /> hereunder was ended by the expiration of the time fixed herein, and <br /> C.A.F. shall remain liable for any unpaid amount owed under Part III. <br /> If City shall be in default in performing any of the terms or <br /> provisions of this lease required on its part to be performed, and <br /> C.A.F. shall give City notice in writing of such default, and if City <br /> shall fail to cure such default within thirty (30) days after service <br /> of such notice, then in such event, the lease shall be terminated and <br /> cancelled. <br /> Prior to the event, C.A.F. agrees to provide City with progress <br /> reports and plans as required by the City. <br /> XVII. <br /> C.A.F. for itself, its successors in interest, and assigns, as <br /> a part of the consideration hereof, does hereby covenant and agree <br /> that: (1) no person on the grounds of race, color, or national <br /> origin shall be excluded from participation in, denied the benefits <br /> of, or be otherwise subjected to discrimination in the use of said <br /> facilities, (2) that in the construction of any improvements on, <br /> over, or under such land and the furnishing of services thereon, no <br /> person on the grounds of race, color, or national origin shall be <br /> excluded from participation in, denied the benefits of, or otherwise <br /> be subjected to discrimination, ( 3) that C.A.F. shall use the premises <br />
