<br /> ~ ",,) TO EXECUTE A GENERAL WARRANTY DEED CONVEYING
<br /> SAID TRACT AND DECLARING AN EFFECTIVE DATE.
<br /> WHEREAS, the City of San Marcos, Texas, is the owner of a
<br /> certain tract of land located in Hays County~ Texas, crossing
<br /> over and a part of Lots 1 through 8, Block 3 of the H.A.
<br /> Nelson's First Addition to the City of San Marcos, Texas, the
<br /> plat of which is duly recorded in Volume 89, Page 224 of the
<br /> Hays County Deed Records; and,
<br /> WHEREAS, the City of San Marcos, Texas, on May 16, 1983,
<br /> granted a perpetual easement over said tract to Southwest Texas
<br /> State University and further granted to Southwest Texas State
<br /> University a ten (10) year option to purchase said tract; and,
<br /> WHEREAS, on August 8, 1983, the City of San Marcos
<br /> received formal notice that Southwest Texas State University
<br /> desires to exercise the option to purchase said tract granted
<br /> to it on May 16, 1983; and
<br /> WHEREAS, the City Council of said City finds the
<br /> consideration for said purchase to be satisfactory; now,
<br /> therefore,
<br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN
<br /> MARCOS, TEXAS:
<br /> SECTION 1. That the price and conditions of the sale by
<br /> the ~ity of San Marcos, Texas, of a certain tract of land
<br /> located in Hays County, Texas, crossing over and a part of Lots
<br /> 1 through 8, Block 3 of the H.A. Nelson's First Addition to the
<br /> City of San Marcos, Texas, more particularly described as
<br /> follows:
<br /> A tract, parcel, or strip of land lying and being
<br /> situated in San Marcos, Hays County, Texas, being
<br /> 10 feet in width, crossing over and a part of Lots
<br /> 1 through 8, Block 3 of the H.A. Nelson's First
<br /> Addition to the City of San Marcos, Texas, the plat
<br /> of which is duly recorded in Volume 89, Page 224,
<br /> of the Hays County Deed Records. Said 10-foot wide
<br /> strip of land is parallel with and adjacent to the
<br /> Northwest boundary line of Lots 1 through 8, and is
<br /> more fully described by metes and bounds as
<br /> follows, to-wit:
