Mayor Craddock introduced for consideration approval of an Ordinance on first reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CI~Y OF SAN MARCOS, TEXAS, AMENDING CHAPTER 12 GARBAGE AND RUBBISH OF THE CODE OF ORDINANCES OF SAID CITY BY MAKING BIL- LING FOR GARBAGE AND RUBBISH COLLECTION MANDATORY; PROVIDING A REQUIREMENT FOR DOCUMENTING COLLECTION CONTRACTS; AND DECLARING AN EFFECTIVE DATE. Mr. Coddington moved to approve the Ordinance on first reading and to amend the Ordinance in Section 1. (c) as follows: " [G]arbage . . . and rubbish collection shall be billed to the owner of the residen- tial unit unless other arrangements are made between the City, the City's contractor and the owner of the property for the assumption of responsibility for garbage and rubbish collection charges. " . . . Ms. Kissler seconded approval and the amendment, which passed unani- mously. Mayor Craddock introduced for consideration approval of an Ordinance on first reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND LAND, DATED JUNE 13, 1984 (VOL. 66) BY CHANGING THE ZONING OF 0.8820 ACRE (38,421 SQUARE FEET) IN THE CITY OF SAN MARCOS, HAYS COUNTY, TEXAS, CONSISTING OF ALL OF LOTS 23 AND 24 AND A POR- TION OF LOTS 21 AND 22 OF COERS ADDITION, SECTION 2 OF THE CITY OF SAN MARCOS, THE PLAT OF WHICH IS RE- CORDED IN VOLUME 169, PAGE 127 OF THE DEED RECORDS OF SAID COUNTY, AND ALL OF THAT 5236 SQUARE FOOT TRACT CONVEYED BY MRS. A. G. COERS TO W. D. LOVELADY AND RUBY LOVELADY BY DEED DATED 15 MARCH 1958, FILED 11 JANUARY 1961, AND RECORDED ON 6 FEBRUARY 1961 IN VOLUME 184, PAGES 570-571 OF THE DEED RECORDS OF SAID COUNTY, LO- CATED IN THE VICINITY OF RANCH ROAD 12 AND COERS DRIVE, FROM "R-l" (SINGLE-FAMILY DWELLING DISTRICT) TO "OP" (OFFICE PROFESSIONAL DISTRICT); AMENDING THE FUTURE LAND USE PLAN (MAP) OF THE MASTER PLAN OF SAID CITY AND DECLARING AN EFFECTIVE DATE. Mr. Coddington moved to approve the Ordinance on first reading and Ms. Kissler seconded the motion. On roll call the following vote was recorded: AYE: Coddington. NAY: Brown, Farr, Craddock, Guerra, Kissler, Nicola. ABSTAIN: None. The motion failed. (Public hearing was held July 8, 1985).
