-7- (a) the use designation of the structure pursuant to Section 30-44; and/or (b) the numerical considerations or determinations of the LUE Factors used in computing the CRFN pursuant to Section 30-45 or Section 30-47 Such appeal shall be heard by the City Council at its next regularly scheduled meeting, subject to Article 6252-17, Vernon's Annotated civil Statutes, notice requirements. Any aggrieved party may present evidence directly relevant and material to the grounds that form the basis for such appeal regarding the appeal. The Council, after hearing such appeal, shall have the authority to amend, recalculate or approve the CRFN previously derived relating to the appealed matter. Section 30-48. Capital Recovery Fee for New Sewerage Use From Existing Customers (CRFEC). 1. When the City Public Works Director determines a customer has constructed new structures on property served by the City's sewerage system without having by law to request a building or Plumbing Permit as per Chapter 5 and 20, then the Public Works Director shall notify, In writing, said customer that a capital recovery fee will be derived and charged to the customer as follows: (a) Notification in writing, lS sent to customer citing that construction has taken place on subject property and that a capital recovery fee will be charged to the customer. (b) The CRFEC will be based on the difference between sewerage usage for the 12-month period following notification and the 12-month period preceding notification. (c) After no"tification, the Director will maintain records for "the following 12 month period in order to establish the CRFEC. (d) The fee will be derived using the following formula. CRFEC= Capital recovery fee for new sewerage use on existing customers. LUEEC= Living unit equivalent for existing customer. CRF= Capital recovery fee. LUEEC= (gallons of sewage in 12-month period mlnus gallons of sewage In preceding l2-month period) divided by 127,750 gallons/12-month period;
