<br /> -9- <br /> of appropriate obligations by the City for <br /> necessary sewerage system improvements or <br /> is available because of newly constructed <br /> sewerage system facility improvements, and <br /> that the granting of the reservation of <br /> capacity is approved by the City Council <br /> by resolution authorizing the ~layor to <br /> enter into an agreement granting such <br /> reservation of capacity. <br /> d) If the party who has been granted a <br /> reservation of capacity does not utilize <br /> the entire amount of the reservation by <br /> t11e time stated in the agreement, the <br /> remaining capacity will revert to the City <br /> to be used as the City determines with no <br /> refund from .the City to the party with <br /> said reservation, but without prejudice to <br /> the party to reapply for another <br /> reservation subsequent to such reversion. <br /> 2. ymen a party wishes to secure from the City <br /> of San Marcos an advance commitment to <br /> reserve sewerage treatment capacity for <br /> single family detached dwelling unit <br /> devlopment, with development to be considered <br /> under this Ordinance to be a land area for <br /> planned construction of more than one single <br /> family dwelling unit, the party may do so <br /> provided tha-t the following conditions are <br /> met: <br /> a) The CRF be paid in advance at the rate of <br /> $900 per living unit equivalent; <br /> b) The commitment given to the party who <br /> seeks the said capacity will not be <br /> transferable (other than as provided <br /> below) and will be in effect for a period <br /> not to exceed six (6) years from the date <br /> of the signing of the reservation by the <br /> Mayor of the City; <br /> c) Before the cornrni tment is granted to the <br /> party who seeks the said capacity, a <br /> determination will be made by the Public <br /> Works Director that the capacity being <br /> requested is either capacity which is <br /> available at the existing treatment plants <br /> as of the effective date of this Ordinance <br /> or the capacity being requested is <br /> capacity being developed as evidenced by <br /> the sale of appropriate obligations by the <br /> City for necessary sewerage system <br /> improvements, or the capacity being <br /> requested is capacity available because of <br /> newly constructed sewerage system facility <br /> improvements. This determination will be <br /> forwarded to City Council along with a <br /> description of the property where the <br /> reservation will be used and other <br /> appropriate information; <br /> d) For the purpose of this subsection, <br /> Section 30-49.2, the reservation will be <br /> considered applied and non-revertable to <br /> the City when the property as described in <br /> the reservation has been properly <br />
