<br />52 <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />Regular Meeting September 9, 1985 Page 6 <br /> <br /> <br />Mayor Craddock introduced for consideration the appeal of Brown <br />Distributing Company regarding Section 5(D), Conformance to Master <br />Plan, of the Zoning Ordinance (Appendix A, Code of Ordinances). <br />Frank Robbins stated Brown Distributing had applied for nonconform- <br />ing use for both zoning and land use. ZBOA denied the variances of <br />zoning and land use, but they do not have authority to make a deci- <br />sion on land use and a zoning variance can properly be appealed to <br />the court system. Lamar Hankins referred the Council to Section 5(D) <br />of the Zoning Ordinance and advised the Council they could amend this <br />Section if they chose to. Malcolm Robinson, an attorney from Austin, <br />was present representing Brown Distributing and gave the Council a <br />history of the company. Mayor Craddock asked the City Attorney to <br />pursue alternatives for the Council's consideration that would assist <br />Brown Distributing. Mr. Farr stated he would like to see the process <br />resolved but does not want the avenue for expansion of nonconforming <br />uses to be opened. Gordon Davis, contractor for Brown Distributing, <br />reviewed their plans for expansion and stated traffic would be relieved <br />by the requested expansion because it would get the trucks off the <br />streets. He stated future expansion of their facilities would require <br />them to move to another area. A. C. Gonzalez asked if ZBOA could rehear <br />this matter and Mr. Hankins stated they did not have authority to grant <br />variances to land use and he is looking into other areas, such as if <br />the variance solved a problem could it be granted. Karl Brown asked <br />if any of the neighbors wanted to respond. Greer Swanson and Joyce <br />Mobley were in favor of the expansion and commended Brown Distributing <br />for wanting to work with the neighbors to alleviate the traffic con- <br />gestion caused by the trucks. Eloisa Hernandez lives across from Brown <br />Distributing and does not think it is proper to have a business in <br />her residential neighborhood nor does she appreciate the view of the <br />warehouse. It was consensus of the Council for Mr. Hankins to pursue <br />alternatives to be presented to the Council at a future date. <br /> <br />Mayor Craddock introduced the receiving of the Parks and Recreation <br />Board's recommendations regarding the Fish Hatchery Building. Mayor <br />Craddock moved to receive the written recommendations and Mr. Guerra <br />seconded the motion, which passed unanimously. <br /> <br />Mayor Craddock introduced for consideration approval to name the Fish <br />Hatchery Building. Mayor Craddock moved to name the building "Old Fish <br />Hatchery Community Building" and Ms. Kissler seconded the motion, which <br />passed unanimously. <br /> <br />Mayor Craddock introduced for consideration approval for janitorial <br />service for the Fish Hatchery Building. Mayor Craddock moved the City <br />contract with the contractor for City Hall and Mr. Farr seconded the <br />motion, which passed unanimously (Mr. Guerra did not vote on this item). <br /> <br />Mayor Craddock introduced for consideration approval for person respon- <br />sible for the use of the Fish Hatchery Building and how the building will <br />be utilized. Mr. Farr moved Terry Colley be the staff person and that <br />low activity be planned for the building's use and included Mr. Guerra's <br />recommendation to delete Parks' recommendation 2a that no alcohol be <br />allowed but that strong guidelines be set and brought to the Council <br />at the September 23 meeting for their approval and Mr. Nicola seconded <br />the motion. Mr. Farr then withdrew his motion and Mr. Nicola his se~ <br />condo Mayor Craddock then moved that all the general rules as set out <br />by the Parks Board be approved for now and the alcohol guidelines to be <br />presented to the Council at a later point and Terry Colley to be the <br />Staff person in charge of the building. Ms. Kissler seconded the motion. <br />On roll call the following vote was recorded: <br /> <br />AYE: Brown, Farr, Craddock, Guerra, Kissler. <br /> <br />NAY: Coddington, Nicola. <br />ABSTAIN: None. <br />
