RESOLUTION NO.2014 -78R <br />A RESOLUTION OF THE CITY OF SAN MARCOS, <br />TEXAS, AUTHORIZING THE SUSPENSION OF AN APPLICATION BY <br />CENTERPOINT ENERGY TEXAS GAS TO INCREASE THE FIXED <br />MONTHLY CHARGE FOR THE GAS RELIABILITY <br />INFRASTRUCTURE PROGRAM FROM THE EFFECTIVE DATE OF <br />MAY 30, 2014, FOR FORTY -FIVE DAYS; AUTHORIZING THE HIRING <br />OF SPECIAL COUNSEL; DETERMINING THAT THE MEETING AT <br />WHICH THIS RESOLUTION WAS ADOPTED COMPLIED WITH <br />THE TEXAS OPEN MEETINGS ACT; MAKING SUCH OTHER <br />FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND <br />DECLARING AN EFFECTIVE DATE. <br />WHEREAS, on or about March 31, 2014 CenterPoint Energy Texas Gas ( "CenterPoint ") <br />delivered an application with the City Secretary to increase the fixed monthly base charge by a <br />total of total of $15,855,203 for the South Texas Division; and <br />WHEREAS, CenterPoint is requesting that the fixed monthly charge increase by $1.00 per <br />month for residential customers, $2.03 per month for small business customer and $12.54 for <br />larger volume customers; and <br />WHEREAS, the City of San Marcos ( "City ") is authorized by statute to examine the filing for <br />mathematical accuracy; and <br />WHEREAS, in order for the City to carry out its responsibilities to review the accuracy and <br />appropriateness of the request for an increase in the fixed monthly charge, additional time <br />beyond the effective date of May 30, 2014 is required; and <br />WHEREAS, hiring special counsel with ratemaking expertise will help the City complete its <br />mission within the short time period allotted for the review of CenterPoint's requested <br />increase in the fixed monthly charge. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR THE CITY <br />OF SAN MARCOS, TEXAS THAT: <br />Section 1.
