Mayor <br />Narvaiz stated the contractor has not abided by the contract and does not <br />feel they should be funded. Mr. Thomaides agrees with Mr. Guerrero giving <br />them one year. On roll call for the amendment the following vote was <br />recorded: <br />AYE: Narvaiz. <br />NAY: Thomaides, Couch, Bose, Jones, Robertson and Guerrero. <br />ABSTAIN: None. <br />Mayor Narvaiz moved to amend the Ordinance .... to leave the $250,000 for <br />Energy investments in the fund balance, and Mr. Guerrero seconded the <br />motion. Mayor Narvaiz stated the Workshop is not until October and feels <br />the money should be set aside until have the Workshop and outline a policy. <br />Rosie Vela, Director of Finance, stated she is concern about moving funds <br />since the Budget Summary was already published. Ms. Robertson stated the <br />Energy Investments was for the energy audit, and purchase of hybrid <br />vehicles. On roll call for the amendment the following vote was recorded: <br />AYE: Narvaiz. <br />NAY: Thomaides, Couch, Bose, Jones, Robertson and Guerrero. <br />ABSTAIN: None. <br />Motion to amend failed. Mayor Narvaiz stated she wanted to make sure that <br />this Ordinance is only approving just the current Fiscal Year on the CIP. <br />She stated she would like to work with the City Manager to replace the <br />current process. Ms. Robertson inquired to page 181, which listed the <br />changes, and it also list FY 08 expenditures. Mr. O'Leary stated page 181 <br />are the decreases from this year's budget. He stated the saving will be <br />pulled out, because allocated now, and not due until next year. We are <br />deducting from this years budget. Ms. Couch stated she agrees with Mayor <br />Narvaiz regarding the CIP for this year only and creating a new process. The <br />Council then voted unanimously for the adoption of the Ordinance on <br />emergency. <br />Mayor Narvaiz stated due to the later hour she was moving up Item #27, due <br />to the late hour. Mayor Narvaiz introduced for consideration adoption of an <br />Ordinance on emergency, the caption was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />SETTING THE TAX RATE FOR THE 2007 TAX YEAR; LEVYING TAXES FOR THE USE <br />AND SUPPORT OF THE MUNICIPAL GOVERNMENT OF THE CITY FOR THE FISCAL <br />YEAR BEGINNING OCTOBER 1, 2007, AND ENDING SEPTEMBER 30, 2008; <br />PROVIDING A SINKING FUND FOR THE RETIREMENT OF THE BONDED DEBT OF THE <br />CITY; INCLUDING PROCEDURAL PROVISIONS; AND DECLARING AN EMERGENCY. <br />Ms. Robertson moved for4 adoption of the Ordinance on emergency; Mr. <br />Guerrero seconded the motion, which passed unanimously. <br />
