The State of Texas <br />County of Hays <br />INTERLOCAL AGREEMENT <br />BETWEEN THE CITY OF SAN MARCOS, TEXAS AND <br />THE COUNTY OF HAYS, TEXAS <br />2014 BYRNE JUSTICE ASSISTANCE GRANT (JAG) PROGRAM AWARD <br />This Agreement is made and entered into this jday of Mn g. , 2014 (the "Effective <br />Date ") by and between the County of Hays, acting by and through its governing body, the <br />Commissioners Court, hereinafter referred to as COUNTY, and the City of San Marcos, acting <br />by and through its governing body, the City Council, hereinafter referred to as CITY, both of <br />Hays County, State of Texas, witnesseth: <br />WHEREAS, the U.S. Department of Justice requires that entities in a disparate allocation <br />of Justice Assistance Grant (JAG) funding enter into an Agreement to provide for the use of <br />those fiords awarded; and <br />WHEREAS, this Agreement is made under the authority of the Interlocal Cooperation <br />Act, Chapter 791 of the Texas Government Code, as amended: and <br />WHEREAS, each governing body, in performing governmental functions or in paying <br />for the performance of governmental functions hereunder, shall make that performance or those <br />payments from current revenues legally available to that party: and <br />WHEREAS, each goveming body finds that the performance of this Agreement is in the <br />best interest of both parties, that the undertaking will benefit the public, and that the division of <br />costs fairly compensates the performing party for the services or functions under this agreement: <br />and <br />WHEREAS, the COUNTY is eligible for $13,104.00 from the direct JAG award, and the <br />CITY did not qualify for a direct award in this disparate allocation; and <br />
