CITY OF SAN MARCOS ELECTRIC RULES AND REGULATIONS <br />part of, an Application for Service. In this agreement, unless otherwise specifically <br />agreed to by the City, the Customer agrees to be bound by the terms of the Rules and <br />Regulations applying to retail electric service as well as the City's other applicable <br />policies and procedures, the Electric Service Standards and any applicable Rate <br />Schedule(s) as they exist, and as amended. <br />APPLICATION FOR SERVICE <br />Electric service supplied by the City will be 60 -cycle alternating current delivered at the <br />available standard voltages adjacent to the premises where the customer is located. <br />Secondary service will be supplied at nominal voltages of 120/240 volt single phase, three <br />phase voltages of 120/208 volt, 120/240 volt, 277/480 volt, and 240/480 volts, or such <br />other voltage as is available. Primary service will be supplied at nominal voltage below <br />15,000 volts as available. <br />The City will provide electric service and administer these Rules and Regulations. <br />Before purchasing or installing electrical equipment and /or wiring, the customer should <br />secure information in writing from the City as to the type of service available at the <br />location to be served. <br />CONTINUITY OF SERVICE <br />The city does not guarantee, but with the cooperation of the customer, will endeavor to <br />furnish a continuous supply of electric power and energy and to maintain voltage and <br />frequency but does not guarantee the service against an irregularity, fluctuation or <br />interruption. <br />The City may interrupt a customer's service when necessary to repair, change, or relocate <br />the City's equipment and facilities. The City is not liable for damage resulting from <br />interrupted service for repair, change, or relocation. <br />LIMITATION ON CITY'S LIABILITY; RELEASE. <br />A. The City is not liable to a customer or to any other person, for property damage, <br />personal injury, business damage, whether direct or consequential, or other loss resulting <br />from a power black -out, power brown -out, interruption or failure of electric service, delay <br />in commencing service, low voltage, high voltage, power surges, or fluctuation of power <br />voltage, wave form, or frequency, caused by a negligent or non - negligent act of the City <br />except for gross negligence or intentional misconduct. <br />B. A customer shall release and hold the City harmless for any damage, injury or <br />loss described in this section. <br />APPLICATION FOR SERVICE <br />A. General <br />
