CITY OF SAN MARCOS ELECTRIC RULES AND REGULATIONS <br />A. The City will exercise reasonable diligence and care to avoid any interruption of <br />or reduction in the delivery of electricity. The City shall not be liable for any <br />damages or claims arising from any failure to deliver electric power and energy to <br />the customer, which failure in any way or manner results from failure of its <br />facilities, however caused, or from failure of any supplier to provide necessary <br />products, materials or services necessary to the continuity of electric service. <br />B. The City, whenever it shall find it necessary for the purpose of making repairs or <br />improvements to its system, will have the right to interrupt temporarily the <br />delivery of service. Normally, when a primary distribution line clearance is <br />needed, reasonable notice will be given to the customers of the proposed <br />interruption when it occurs other than under emergency conditions. The city <br />considers notice to customers by way of public media to be a reasonable notice. <br />The making of such repairs as practicable, to cause the least inconvenience to the <br />customer. <br />CITY'S RIGHT TO ACCESS TO CUSTOMER'S PREMISES <br />The City shall have the right to access to the customer's premises for any purpose <br />reasonably connected with the furnishing of electricity to its customers. <br />The City shall have the right to remove its property installed on the customer's premises at <br />the termination or discontinuance of service. <br />SERVICE CONNECTIONS MADE BY CITY <br />Only duly authorized employees of the City are allowed to connect the Customer's <br />service to or disconnect the same from, the City power line. <br />CHANGES IN RATES, RULES AND REGULATIONS <br />The rates, rules and regulations contained in this tariff may be changed from time to time. <br />New rates, rules and regulations shall become effective on the date specified thereon and <br />shall on that date alter, amend, supersede or replace as the case may be, any existing rates, <br />rules, and regulations. <br />REFUSAL OF SERVICE <br />Compliance by Applicant <br />The city may decline to serve an applicant until such applicant has complied with <br />the state and municipal regulations and approved rules and regulations of the city <br />for the following reasons: <br />(1) Applicant's facilities inadequate: If the applicant's installation or <br />equipment is known to be hazardous or of such character that satisfactory <br />service cannot be given; <br />(2) For indebtedness: If the applicant is indebted to the city for any kind of <br />municipal service; <br />(3) Refusal to make deposit: For refusal to make the required cash deposit; <br />12 <br />
