<br />81 <br />Regular Meeting March 27, 1989 Page 4 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS, AMENDING APPENDIX A - GENERAL ZONING ORDINANCE OF THE <br /> CODE OF ORDINANCES OF SAID CITY BY ADDING A DEFINITION FOR <br /> BED AND BREAKFAST INN; MODIFYING THE DEFINITION OF HOME <br /> OCCUPATION; UPDATING THE LIST OF ZONING DISTRICTS <br /> DESIGNATED; CHANGING THE ZERO LOT-LINE DWELLING DISTRICT <br /> DESIGNATION FROM ZL-l TO ZL; DELETING SUBSECTION 25(D)-M <br /> SINGLE-FAMILY, DUPLEX AND NEIGHBORHOOD BUSINESS DISTRICT; <br /> ADDING "P" AS THE LETTER DESIGNATION FOR THE PUBLIC AND <br /> INSTITUTIONAL DISTRICT IN SECTION 26; ADDING "BED AND <br /> BREAKFAST INN" AS A PERMITTED USE IN A COMMERCIAL DISTRICT; <br /> DELETING A DUPLICATE PROVISION IN SECTION 32(B) - LIGHT <br /> INDUSTRIAL DISTRICT; RENUMBERING THE REMAINING PARAGRAPHS IN <br /> SECTION 32(B) IN PROPER SEQUENCE; ADDING A NEW SET OF <br /> SPECIFIC USE PERMIT CONDITIONS FOR CHILD DAY CARE AND BED <br /> AND BREAKFAST INNS CONDUCTED AS HOME OCCUPATIONS; MODIFYING <br /> SECTION 36 - SUPPLEMENTAL AREA REQUIREMENTS; ADDING <br /> OFF-STREET PARKING REQUIREMENTS FOR VEHICLE SALES AND RENTAL <br /> BUSINESSES; CLARIFYING THAT PARKING LOT PAVING REQUIREMENTS <br /> APPLY TO DISPLAY AREAS FOR THE SALE OR RENTAL OF VEHICLES; <br /> SPECIFYING THAT STANDARDS FOR HANDICAPPED PARKING SPACES BE <br /> CONSISTENT WITH THOSE CONTAINED IN THE BUILDING CODE; ADDING <br /> A NEW STANDARD REQUIRING LANDSCAPING ~D TREES WITHIN THE <br /> PERIMETER OF THE PAVED AREA OF CERTAIN PARKING LOTS; <br /> MODIFYING A PROVISION ALLOWING SPECIAL EXCEPTIONS TO WAIVE <br /> OR REDUCE PARKING AND LOADING REQUIREMENTS BY ADDING <br /> SPECIFIC STANDARDS; ADDING A CLARIFICATION THAT SPECIAL <br /> EXCEPTIONS FOR EXPANSION OF A PRE-EXISTING NONCONFORMING USE <br /> ARE SUBJECT TO COMPLIANCE WITH POLICIES OF THE MASTER PLAN <br /> WITH REGARD TO LAND USE COMPATIBILITY; AND DECLARING AN <br /> EFFECTIVE DATE. <br />Mr. Moore moved for approval of the Ordinance on first reading <br />and Ms. Kissler seconded the motion. Henry Kyle, representing <br />Chris Luna, requested Parts 14 and 15 be deleted from this <br />Ordinance, as Mr. Luna claims these amendments will run him out <br />of business. Dan Gibson stated the amendments in this Ordinance <br />would not be retroactive. Mr. Moore asked Mr. Gibson if the <br />Zoning Commission had looked at alternative types of surfaces for <br />routing pollutants, and Mr. Gibson stated the Zoning Commission <br />is looking at amending the Ordinance in the future to provide an <br />alternative surface of pervious paver. Gayle Grassle advised the <br />Council Mr. Luna did not have enough proper off-street parking at <br />his new location and wanted a variance to place cars for sale on <br />an unpaved area. The Council voiced concern of the existing <br />paving requirements. Mayor Morris moved to amend the Ordinance <br />on Page 2, Part. 3, Sec. 5. (B) to change the "P" designation to <br />read as follows: "p Public and Institutional District", and Mr. <br />Moore seconded the motion, which passed unanimously. Discussion <br />pursued regarding the paving requirements (Parts 14 and 15). Mr. <br />Guerra moved to delete Parts 14 and 15 and Mr. Hernandez seconded <br />the motion, which passed unanimously. The Council voted <br />unanimously for approval of the Ordinance on first reading. <br />Staff was directed to provide the Council with the existing <br />Ordinance wording for review, and to provide rewording of Parts <br />14 and 15 for the Council's consideration for second reading. <br />Mayor Morris introduced for consideration approval of minutes of <br />the Regular Meeting held March 13, 1989, adoption of an Ordinance <br />on third and final reading and adoption of five Resolutions <br />on consensus. The City Council requested Items 7.B., 7.C.(3) and <br />7 .C. (5) be considered separately. Mr. Hernandez moved to approve <br />the minutes of the Regular Meeting held March 13, 1989 (Messrs. <br />Hernandez, Guerra and Moore abstaining) and adoption of the three <br />remaining Resolutions by consensus and Mr. Brown seconded the <br />motion, which passed unanimously.
