<br /> 80 <br />Regular Meeting March 27, 1989 Page 3 <br />on the ground by June 1st. The Shelter is currently on a <br />month-to-month lease. They need one acre for the site and would <br />consider alternative sites to their request. They want to pursue <br />the possibility of a thirty-year lease with an option for an <br />extension of thirty years, with the property to revert to the <br />City. The grantor needs to be advised of the need for a zoning <br />change. The Mayor proposed the secondary site be considered with <br />a lease to be prepared with the Shelter to be responsible for the <br />payment of utilities. Mr. Gilley advised a portion of the <br />property is used by the Texas Department of Public Safety, and <br />the City uses part of the property for fire department training <br />and storage. Anna Lopez, a Board Member of the Shelter, stated <br />the Shelter badly needs more space and that the Shelter offers <br />children the opportunity to be reunited with their families <br />successfully and have a successful truancy program. Direction <br />was given Staff to proceed to prepare a lease agreement and <br />zoning and land use amendments at the secondary location. <br />Mayor Morris advised the Council would have a short recess and <br />then go to a portion of Item 13 on the Agenda. Mr. Hernandez <br />moved the Council adjourn into Executive Session pursuant to <br />Article 6252-17/ Section 2(g), V.A.C.S., to discuss evaluation <br />and duties of a public officer or employee and Mr. Brown seconded <br />the motion, which passed unanimously (8:50 p.m.). <br />Mr. Hernandez moved the Council reconvene at 9:47 p.m. and Mr. <br />Moore seconded the motion, which passed unanimously. <br />Mayor Morris introduced for consideration Item 6.A., approval of <br />the Ordinance on first reading, the caption which was read as <br />follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS, AMENDING CHAPTER 14 OF THE CODE OF ORDINANCES OF SAID <br /> CITY TO ADOPT THE 1988 EDITION OF THE STANDARD HOUSING CODE <br /> AND SUBSEQUENT REVISIONS THERETO, AND DECLARING AN EFFECTIVE <br /> DATE. <br />Ms. Kissler moved for approval of the Ordinance on first reading <br />and Mr. Moore seconded the motion, which passed unanimously. <br />Mayor Morris introduced for consideration approval of an <br />Ordinance on first reading, the caption which was read as <br />follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS, DEDICATING REAL PROPERTY COMPRISING ALL OF BLOCK 25 <br /> OF THE SECOND SECTION OF VICTORY GARDENS AS PARKLAND, ~D <br /> DECLARING AN EFFECTIVE DATE. <br />Mr. Hernandez moved for approval of the Ordinance on first <br />reading and Mr. Moore seconded the motion. Mr. Hernandez stated <br />H.E.B. had donated playground equipment at a dedication held <br />earlier during the day and commended the private and public <br />sectors working together to make this possible. Mayor Morris <br />challenged businesses, individuals and children to enter into <br />public partnerships such as this. She stated it would be the <br />City's responsibility to maintain the park and hopes the <br />community will respond to this need for other areas. She stated <br />H.E.B. had paid for the equipment, its employees provided the <br />labor in assembling the equipment, and it was truly an act of <br />love.
