<br /> -2- <br /> its officials, officers, employees and agents from any and <br /> all claims, obligations or causes of action that you may have in <br /> connection with your employment at or separation from the <br /> City of San Marcos. <br />6. You ag ree to keep confidential all private, non-public, <br /> information including all matters relating to the "public <br /> trust" doctrine, which you have received or learned about the <br /> City of San Marcos as a result of, or by virtue of, your <br /> confidential relationship with City officials and employees of <br /> the City of San Marcos. <br />7. You agree to refrain from representing any person or entity in <br /> any lawsuit against or any administrative proceeding before the <br /> City of San Marcos, or any city Commission or Board for a period <br /> of four ( 4) months following the effective date of your <br /> resignation. <br />8. You agree to fully cooperate with the City's prosecution or <br /> defense of, or involvement with litigation pending on the <br /> effective date of your resignation or arising from events which <br /> took place during your tenure as City Attorney at no additional <br /> cost to the City. <br />9. You agree to testify as a witness, when requested to do so by the <br /> City, in all lawsuits to which the City is a party and which are <br /> pending on the effective date of your resignation at no <br /> additional cost to City. <br />10. You agree to refrain from making any critical comments to the <br /> public regarding the City or the City Council. <br />11. You agree to return to the City's Legal Department and Mayor <br /> immediately upon your execution ,of this Agreement all property of <br /> the City of San Marcos, including but not limited to keys, <br /> books, files, and papers. <br />12. No employee of the City shall be authorized to give any <br /> information to any person or entity except those matters which <br /> may be disclosed under the Texas Open Records Act. The <br /> undersigned City Council Members shall not comment on your <br /> employment or the events surrounding your resignation other than <br /> to provide information previously made public or to respond to <br /> inquiries in the manner described in the preceding sentence. <br />This severance agreement sets forth the entire agreement between the <br />parties hereto and fully supersedes any and all prior agreements or <br />understandings between the parties hereto pertaining to the subject <br />matter hereof. <br />
