<br />103 <br /> <br /> <br /> <br /> <br /> <br />Regular Meeting August 14, 1989 Page 6 <br /> <br /> <br />the Functional Replacement of Gary Job Corps Facilities Project. <br />Mr. Guerra moved for approval of the change order and Ms. Kissler <br />seconded the motion, which passed unanimously (Mr. Hernandez not <br />present to vote on this item). <br /> <br />Mayor Morris introduced for discussion and consideration <br />authorizing legal counsel to file suit for collection of <br />delinquent hotel/motel occupancy taxes from Ramada Inn. Mr. <br />Guerra moved to authorize Soules & Wallace to file suit against <br />Ramada Inn and Mayor Morris seconded the motion. Mr. Kosub <br />advised the Council Ramada Inn was in arrears four quarters <br />totaling $42,500. The Council voted unanimously for <br />authorization to file suit. <br /> <br />Mayor Morris introduced a discussion regarding a Groundwater <br />Assessment Study relating to the contamination at the former <br />landfill site (estimated cost $23,000) and direction to Staff to <br />prepare a Budget Amendment Ordinance from the Landfill Reserve <br />Fund. The City needs a grounqwater monitoring need assessment <br />for the placement of monitoring wells. A consultant needs to <br />review the topo and groundwater studies we have and determine <br />where upstream the groundwater is and recommend the placement of <br />the wells. There is an advantage for the City in having such a <br />study: if contamination is found in the future, the City will be <br />able to identify who is responsible for the contamination. <br />Presently the City is expending $4,000 plus for testing. The <br />Council directed Staff prepare a Budget Amendment Ordinance. <br /> <br />Mayor Morris introduced a discussion regarding a Comprehensive <br />San Marcos River Maintenance Plan. Mr. Cobb advised the Council <br />Staff has been unable to find equipment suitable to mow and <br />harvest the river. The Council reviewed a proposal for <br />maintenance attached to these minutes. Mr. Cobb stated a change <br />is needed in the proposal in the title of "coordinator" to <br />"steward". Mr. Cobb stated the City could contract with SWT with <br />specifications what we want the results of their efforts to be. <br />Since it is for professional services, the City can choose to bid <br />or not to bid for these services. The Parks and Recreation Board <br />did review another proposal. Mayor Morris stated the attached <br />proposal could work as an interlocal agreement with SWT and <br />thinks the City should utilize the resources of the University. <br />John Wade stated there is a possibility of matching funds <br />available through the U. S. Parks and Wildlife Department in <br />Phase III of the proposal. SWT students involved in such a <br />proposal could be paid through the Federal government, the <br />Geography Department could do river mapping with interns in the <br />river and equipment belonging to the University could be used. <br />The proposal includes a $700 monthly salary for the steward of <br />the program (Paula Power). The proposal only covers a two-year <br />period, and the Council wanted to know what happens at the end of <br />that period. Mr. Cobb advised there is a 1 in 5 chance of <br />receiving a grant for federal funding at that time. <br />Fraternities, sororities and community groups could assist with <br />river cleanups. Mary Cauble, Chairman of the Parks and <br />Recreation Board, advised the Council the Board preferred the <br />attached proposal to the other one reviewed by them, but the <br />Board wanted Mr. Cobb to be involved in all of the process. <br />There is a river cleanup scheduled in October that will include <br />divers and canoes. <br /> <br />Mayor Morris introduced an Executive Session pursuant to Article <br />6252-17, Sections 2(e) and (g), V.A.C.S., to discuss pending <br />litigation (MacKenzie vs. City; Guadalupe-Blanco River Authority <br />vs. City of Lytle, Et AI, Cause No. 89-0382 in the 22nd Judicial <br />District Court of Hays County, Texas), contemplated litigation <br />(Guadalupe-Blanco River Authority - Notice of Endangered Species <br />Act Violations), matters where the duties of the City Attorney to <br />the City pursuant to the Code of Professional Responsibility of <br />the State Bar of Texas clearly conflicts with Article 6252-17; <br />
