2.0 DEFINITIONS <br />As used herein: "County' means Caldwell County, Texas; "Commissioners Court" means the <br />Commissioners Court of Caldwell County, Texas; singular nouns and pronouns shall include the plural; <br />and the masculine gender shall include the feminine gender where necessary for a correct meaning. <br />For the purpose of these Regulations, the following terms, phrases, words, and their derivations shall <br />have the meaning ascribed to them in this Section. All other words and terms shall have their usual <br />force and meaning. <br />• ADT – Average Daily one -way Trips. <br />• Acceptance of Improvements – Upon successful completion of the performance period, the County will <br />accept improvements designated for public maintenance into its roadway system. <br />• Alley — A right -of -way which is used only for secondary access to individual properties which have <br />their primary access from an adjacent street or joint use access easement (JUAE) which has direct <br />access to a public street. <br />• All-weather surface road — A street, road, or drive that is constructed with base material and has a <br />hard surface to ensure access by ambulance, fire trucks, and other emergency vehicles under all <br />weather conditions. <br />• Applicant — The owner, person or entity applying for any permit, approval, variance or waiver under <br />this ordinance. <br />• Approval of Improvements - Upon successful completion of the construction of improvements as <br />defined within this Ordinance, approval of those improvements will be acknowledged by the County <br />and the performance period will begin. <br />• Bluff – Limited to a bluff with a vertical change in elevation in excess of 20 feet and an average <br />gradient in excess of 33 percent. <br />• Building Line — A line beyond which buildings must be set back from the lot or property line. <br />• Chip Seal – A pavement surface treatment that combines layers of asphalt and fine aggregate. Also <br />known as "two course surface treatment" or "asphaltic surface treatment ". <br />• Collector Street — A street or road that collects traffic from other streets and serves as the most direct <br />route to another collector, minor arterial, major arterial, or state highway. <br />• Commercial Site Construction – All construction, site grading, or addition of impervious cover on a <br />parcel of land not otherwise exempted under this ordinance. The following are not considered <br />commercial construction: single family residential; two- family (duplex); or three family (triplex) <br />residential; garages, sheds, barns, swimming pools, gardens or other ancillary out - buildings <br />associated with one to three family residences; conservation open space; barns or agriculture <br />structures not intended for common use by the public; or improvements to increase the agricultural <br />value of property being used for agricultural purposes with fewer than 50 average -daily trips per day. <br />• Commissioners Court — The Caldwell County Commissioners Court; also referred to as the Court. <br />4 <br />
