• County Commissioner - The elected Commissioner of a precinct in Caldwell County in which a <br />subdivision or development is located, or the County Commissioner's designated agent. <br />• County Engineer – The Professional Engineer (PE) appointed by the Commissioners Court to that <br />position or the County's designated agent or engineer employed by the county. <br />• County Representative — The designated agent or employee of the County appointed to review, <br />inspect, administer or implement provisions of this and / or other County ordinances. <br />• County Review Coordinator – The designated agent or employee of the County appointed to perform <br />administrative reviews and receive submittals under this ordinance. <br />• County Road — Any public road or street in which the County has a public interest and has been <br />maintained by the County and is not within the incorporated limits of a city and is not a state highway. <br />• Designated 100 -year Floodplain — Any area adjacent to a stream or water course which, on the <br />average, has a one percent (1 %) chance of being inundated by flood waters in any given year; also <br />referred to as the floodplain or Special Flood Hazard Area (SFHA). <br />• Developer – Any owner, or authorized agent thereof, engaging in subdivision of property, except as <br />specifically exempted under this ordinance. Also referred to as Subdivider or Applicant. <br />• Development— Subdivision of real property, construction of roads and drainge improvements within a <br />subdivision, commercial site construction or construction to alter an existing regulated floodplain. <br />• Development Agreement – A legally binding agreement entered into by a private party or entity and the <br />County which delineates the conditions for a particular development wherein various concessions to <br />the technical requirements of Development Ordinance may be made in exchange for a mutually <br />agreeable alternate standard which meets the intent of the Ordinance and is in the best interest of both <br />parties. <br />• Driveway — An access facility from a street or road for the use by the owners or others. <br />• Engineer — A person who is licensed by the State of Texas as a professional engineer to practice <br />engineering; also referred to as a Professional Engineer (PE). <br />• Excavating — The mechanical removal of earth material. <br />• Exempted Subdivision — Those subdivisions of land that are exempted from platting requirements as <br />provided in Section 232.0015 of the Texas Local Government Code. <br />• Extra - Territorial Jurisdiction (ETJ) — Land located outside of a City's incoporated limits over which the <br />City has jurisdiction under Chapter 42 of the Texas Local Government Code. <br />• Fill — Any act by which earth, sand, gravel, rock or similarly approved material is deposited, placed, <br />pushed, pulled or transported to a place other than the place from which it is excavated and the <br />materials so placed. <br />• Final Plat — A map or drawing of a proposed subdivision prepared in a manner suitable for recording <br />in the County records and prepared in conformance with any conditions of preliminary approval <br />previously granted by the Commissioners Court. <br />
