AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING AN AMENDMENT TO THE FUTURE LAND USE MAP FROM INDUSTRIAL TO <br />COMMERCIAL FOR A 1.7 ACRE, MORE OR LESS, TRACT OF PROPERTY LOCATED AT <br />1560 IH -35 SOUTH; AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY <br />REZONING THIS TRACT FROM "HI" HEAVY INDUSTRIAL DISTRICT TO "GC" <br />GENERAL COMMERCIAL DISTRICT; INCLUDING PROCEDURAL PROVISIONS; AND <br />PROVIDING FOR PENALTIES. <br />Mayor Narvaiz opened the public hearing and asked if anyone wished to <br />speak. No one did, so Mayor Narvaiz closed the public hearing. Mr. Jones <br />moved for adoption of Zoning Ordinance, and Mr. Guerrero seconded the <br />motion, which passed unanimously. <br />Mayor Narvaiz introduced a public hearing and consideration of adoption <br />Zoning Ordinance, the caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING THE FUTURE LAND USE MAP OF THE MASTER PLAN OF THE CITY, FROM <br />PUBLIC TO COMMERCIAL FOR A 2.436 ACRE, MORE OR LESS, TRACT OF PROPERTY <br />LOCATED AT 400 UHLAND ROAD; AMENDING THE OFFICIAL ZONING MAP OF THE <br />CITY BY REZONING THIS TRACT FROM "P" PUBLIC AND INSTITUIONAL DISTRICT <br />TO "NC" NEIGHBORHOOD COMMERCIAL DISTRICT; INCLUDING PROCEDURAL <br />PROVISIONS; AND PROVIDING FOR PENALTIES. <br />Mayor Narvaiz opened the public hearing and asked if anyone wished to <br />speak. No one did, so Mayor Narvaiz closed the public hearing. Mr. <br />Thomaides moved for adoption of Zoning Ordinance, and Ms. Couch seconded <br />the motion. Ms. Robertson stated originally this application was for a <br />zoning change from Public and Institutional to Community Commercial. Carol <br />Barrett, Director of Planning Development Department, stated the Planning <br />and Zoning Commission discussed the issues and recommended approval of the <br />commercial land use designation but recommended denial of the requested GC <br />zoning and recommended NC (neighborhood commercial) zoning as an <br />acceptable compromise. She stated the land use amendment passed on a 9 -0 <br />vote while the zoning case was denied on a vote of 8 -1. She also stated <br />the Ordinance is drafted and posted NC, the public notice read NC, but the <br />Agenda Request Form was never corrected to NC. The Council then voted <br />unanimously for adoption of Zoning Ordinance. <br />Mayor Narvaiz introduced consideration approval of an Ordinance on first <br />reading, the caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING THE CITY'S 2006 -2007 BUDGET TO PROVIDE FUNDING FOR THE <br />OPERATIONS OF THE DRAINAGE MAINTENANCE DIVISION; AND DECLARING AN <br />EFFECTIVE DATE. <br />
