<br />-3- <br /> <br />authorized to do business in the State of Texas to the minimum <br />limit of $100,000.00 per person and $300,000.00 for any single <br />occurrence for bodily injury or death and $100,000.00 for any <br />single occurrence for injury to or destruction of property. <br />Said insurance policy shall name City as co-insured. Said <br />insurance shall contain the endorsement that such insurance may <br />not be cancelled or amended with respect to Club without ten <br />(10) days written notice by certified mail, return receipt <br /> <br /> <br />requested, to City by the insurance company. City shall not <br /> <br />be required to pay any of the premiums for said policy. A copy <br /> <br />of said policy shall be delivered by Club to City within (10) <br /> <br /> <br />days of the inception of such policy by the insurance company. <br /> <br />The minimum limits of any insurance coverage herein required <br /> <br />shall not limit Club's liability under Part V of this Contract. <br /> <br />VII. <br />No right, duties and/or liabilities created herein are <br />assignable. <br /> <br />VIII. <br />Club covenants and agrees not to discriminate upon the <br />basis of age, religion, race, sex or national origin in the <br />operation of Club's inner tIDe rental. <br /> <br />IX. <br />All facilities brought onto City Park by Club shall remain <br />the property of Club, and Club may remove the same upon the <br />termination of this use agreement, provided that such removal <br />shall be done in such a manner as not to injure or damage said <br />parking lot or any other area of City Park. <br /> <br />X. <br />Club's use of City Park premises for its inner tube rental <br />operation shall be in conformity with all laws, ordinances, rules <br />and regulations or orders of all municipal, county, state and <br />federal authorities, boards, commissions and other governmental <br /> <br />agencies. <br /> <br />XI. <br />This use agreement is not intended as a lease of any portion <br />
