<br />-2- <br /> <br />III. <br />Utilities necessary for Club's inner tube rental operation <br />shall be the sole responsibility of Club. A water meter and <br />an electrical meter shall be installed at the expense of Club <br />and Club shall be responsible for water and electricity used <br />during the term which is attributable to said inner tube rental <br /> <br />operation as measured by said meters. <br /> <br />IV. <br />Club shall take good care of said City Park premises and <br />at the expiration of the term shall leave said premises in good <br />order and condition. Club shall insure that the restrooms located <br />at City Park are adequately maintained during the term. At a <br />minimum, said maintenance shall consist of the provision of one <br /> <br />worker to clean said restrooms twice a day, one cleaning to <br /> <br />occur in the morning and one in the afternoon. Said worker to <br /> <br />be provided by Club shall also aid City's employees in picking <br /> <br />up litter from City Park. City shall provide litter barrel pick- <br /> <br /> <br />up in the vicinity of said operation at a minimum of twice a week. <br /> <br />During peak litter periods City shall provide additional pick-ups. <br /> <br /> <br />The existence of peak litter periods shall be determined by City. <br /> <br />V. <br />Club agrees to indemnify and hold harmless City from all <br />damages, claims, losses, demands, suits, judgments, costs and <br />expenses arising from the inner tube rental operation of Club, <br />and shall defend any litigation arising in connection with such <br />operation including reasonable attorneys' fees whenever said <br /> <br />damages, claims, losses, demands, suits, judgments, costs or <br /> <br /> <br />expenses are caused in whole or in part by any negligent act or <br /> <br /> <br />omission of Club, anyone directly or indirectly employed by <br /> <br /> <br />Club or anyone for whose acts Club may be liable regardless of <br /> <br /> <br />whether said damages, claims, losses, demands, suits, judgments, <br /> <br />costs or expenses are caused in part by City. <br /> <br />VI. <br /> <br /> <br />Club agrees to file with the City a policy of public <br /> <br />liability insurance issued by a casualty insurance company duly <br />
