24 THE STATE OF TEXAS COUNTY OF HAYS USE AGREEHENT KNOW ALL MEN BY THESE PRESENTS: Tha t on this the 20thday of April , 1981, the City of San Marcos, Texas, a municipal corporation existing by and under L~e laws of the State of Texas, and acting by authority granted its Mayor Pro Tempore, John J. Stokes, by Resolution duly adopted April 1981, hereinafter referred to as City and the San Marcos Lions Club, acting through its President B.J. Whiteside, hereinafter Club, hereby enter into this use agreement, the term~ conditions and considerations for which are set out as follows: I. For and in consideration of Club's provision of a rec- reational activity for citizens of and visitors to the City of San Marcos, Texas, specifically t~e rental of inner tubes to persons wishing to float down the San Harcos River, City here- by grants permission to Club to conduct its rental operation of said inner tubes at City Park for a term of six (6) months to commence from the first (1st) day of May, 1981, to end on the thirty-first (31st) day of October, 1981. II. Club may bring onto the premises known as City Park in the City of San Marcos, Texas, to-wit: the parking lot at said City Park, facilities adequate for t~e storage of inner tubes in quantitiès sufficient for Club's inner tube rental operation. Club shall also be permitted to bring onto said parking lot facilities adequate for the sale of tickets for said operation. City shall approve both the facility and the location of that facility prior to any placement on said parking lot. Adequate space shall be provided by City for said placement of those facilities necessary for Club's inner tube rental operation.
