103 -2- D. Business Entity: Any corporation, partnership, sole proprietorship, firm, enterprise, franchise, associa- tion, organization, self-employed individual, holding company, joint stock company, receivership, trust, or any legal entity organized for profit. E. Substantial interest: (1) controlling interest in a business entity (2) an employee of a business entity I (3) a creditor, debtor or guarantor of any person or business entity in the amount of two thou- sand dollars ($2,000.00) or more. SECTION 3. Standards of Conduct. A. No officer or employee of the city, or member of their immediate family shall knowingly: (l) 'ACcept or solicit any gift or favor from any person, corporation, or association of persons that might influence said employee or officer in the discharge of official city duties, or grant in the discharge of official duties any improper favor, service or thing of value in consideration of such employee having exercised any official power or having performed any official duty. (2) Accept or solicit any gift or favor, including a promise of future employment or income or a favor or service from any person, corporation or associa- tion of persons: (a) Who is licensed or has a substancial in- terest in any business entity that is licensed by the city, or by any depart- ment, agency, commission, or board on which the officer or employee serves, or I (b) Who has a personal financial interest in any proposed ordinance or decision upon which the city officer or employee mayor must act or make a recommendation~ provided, however, that the mayor, city council members, and any other city officer or employee, and their spouses, may attend purely ceremonial functions. (c) This is not meant to prohibit any person from accepting employment based on competitive application. (3) Disclose any confidential information gained by reason of the position of the officer or employee concerning the property, operations, policies, or I affairs of the city, or use such confidential information to advance any personal interest, finan- cial or otherwise, of such officer or employee, or others. (4) Use one's postion or office of employment, or the city facilities, personnel, equipment, or supplies, for the private gain of the city officer or employee or members of the immediate family.
