<br />103 <br /> <br />-2- <br /> <br />D. Business Entity: Any corporation, partnership, sole <br />proprietorship, firm, enterprise, franchise, associa- <br />tion, organization, self-employed individual, holding <br />company, joint stock company, receivership, trust, or <br />any legal entity organized for profit. <br /> <br />E. Substantial interest: <br /> <br />(1) controlling interest in a business entity <br /> <br />(2) an employee of a business entity <br /> <br />I <br /> <br />(3) a creditor, debtor or guarantor of any person <br />or business entity in the amount of two thou- <br />sand dollars ($2,000.00) or more. <br /> <br />SECTION 3. <br /> <br />Standards of Conduct. <br /> <br />A. No officer or employee of the city, or member of their <br />immediate family shall knowingly: <br /> <br />(l) 'ACcept or solicit any gift or favor from any <br />person, corporation, or association of persons <br />that might influence said employee or officer <br />in the discharge of official city duties, or <br />grant in the discharge of official duties any <br />improper favor, service or thing of value in <br />consideration of such employee having exercised <br />any official power or having performed any official <br />duty. <br /> <br />(2) Accept or solicit any gift or favor, including a <br />promise of future employment or income or a favor <br />or service from any person, corporation or associa- <br />tion of persons: <br /> <br />(a) Who is licensed or has a substancial in- <br />terest in any business entity that is <br />licensed by the city, or by any depart- <br />ment, agency, commission, or board on <br />which the officer or employee serves, or <br /> <br />I <br /> <br />(b) Who has a personal financial interest <br />in any proposed ordinance or decision <br />upon which the city officer or employee <br />mayor must act or make a recommendation~ <br />provided, however, that the mayor, city <br />council members, and any other city officer <br />or employee, and their spouses, may attend <br />purely ceremonial functions. <br /> <br />(c) This is not meant to prohibit any person <br />from accepting employment based on competitive <br />application. <br /> <br />(3) Disclose any confidential information gained by <br />reason of the position of the officer or employee <br />concerning the property, operations, policies, or I <br />affairs of the city, or use such confidential <br />information to advance any personal interest, finan- <br />cial or otherwise, of such officer or employee, <br />or others. <br /> <br />(4) Use one's postion or office of employment, or the <br />city facilities, personnel, equipment, or supplies, <br />for the private gain of the city officer or employee <br />or members of the immediate family. <br />
