<br />M4 <br /> <br />-~ <br /> <br />B. No, officer or employee of the city shall knowingly: <br /> <br />I <br /> <br />(1) Appear before the body of which the officer <br />or employee is a member as a representative <br />for any private person, including the officer or <br />employee or any member of his/her immediate <br />family, or any group, or interest, or represent, <br />directly or indirectly, any private person, in- <br />cluding the officer or employee or any member of <br />his/her immediate family, or any group: or interest <br />before any department, agency. commission or board <br />of the City of San Marcos. <br /> <br />(2) Represent, directly or indirectly, any private <br />person, includin~ the officer or employee or <br />any member of his/her immediate family, or any <br />group, or interest in any action or proceeding <br />against the interests of the city or in any <br />litigation in which the city or any department, <br />agency, commission, or board thereof is a party. <br /> <br />(3) Represent, directly or indirectly, any other <br />private person, including the officer or employee <br />or any member of his/her immediate family, or any <br />group, or interest in any action or proceeding in <br />the municipal courts of the City of San Marcos <br />which was instituted by a city officer or employee <br />in the course of official duties, or a criminal <br />proceeding in which any city officer or employee <br />is a material witness for the prosecution. <br /> <br />I <br /> <br />(4) Accept other employment or engage in outside <br />activities incompatible with the full and proper <br />discharge of city duties and responsibilities, <br />or which might impair independent judgement in <br />the performance of said city duties. <br /> <br />(5) No officer or employee shall be deprived of his/ <br />her right to due process under the law which <br />would include the right to represent himself/her- <br />self in a court proceeding. <br /> <br />SECTION 4, <br /> <br />Disclosure of interest. <br /> <br />A. If any city officer or employee or me~ber of the <br />immediate family has a financial, personal or <br />private interest, direct or indirect, in any in- <br />dividual or entity involved in any decision pending <br />before such officer or employee, or the body of <br />which the officer or employee is a member, the <br />officer or employee shall not vote or otherwise <br />participate in the consideration of the matter. <br /> <br />I <br /> <br />B. The officer shall publicly disclose to the city <br />secretary in writing the nature and extent of such <br />interest. The statement of disclosure shall be <br />included in the official records of the body prior <br />to any discussion or determination of the matter. <br /> <br />C. In the case of any employee, the employee shall <br />disclose such information in writing to the em- <br />ployee's supervisor and to the city secretary <br />prior to any consideration of the matter. The <br />city secretary shall keep a file of employee <br />statements of disclosure and said file shall be <br />a public record of the city. <br />
