<br />109 <br /> <br />-8- <br /> <br />SECTION 5. Forms for Statements. <br /> <br />A. The city secretary shall promulgate a form to be <br />used by persons filing statements required by <br />Section 2 of this article within forty-five (45) <br />days of the adoption of this ordinance. Such <br />statements shall be filed only on that form. The <br />city secretary shall provide a form to any person <br />requesting the same and, not less than ten (10) <br />days before the last day set for filing a state- <br />ment by any person, shall send such forms to such <br />person. <br /> <br />I <br /> <br />B. Persons who are members of the city council on <br />the date Sections 1 through 4 of this article <br />are adopted shall file their initial financial <br />disclosure statements within ninety (90) days <br />after the date of adoption hereof. <br /> <br />ARTICLE III. <br />ETHICS REVIEW CO~~ISSION <br /> <br />SECTION l. Ethics Review Commission established~ composition; <br />term of members <br /> <br />An ethics review commission is hereby established, to <br />be composed of seven (7) members all of whom shall re- <br />side in the City of San Marcos. The commission members <br />shall receive no salary, compensation or remuneration <br />for their services on the commission. Each member of <br />the commission shall serve for a term of two (2) years <br />or until a successor is appointed. The terms shall be <br />staggered, so that the terms of four (4) members shall I <br />expire in June of odd-numbered years and the terms of <br />the other three (3) members shall expire in even numbered <br />years. <br /> <br />SECTION 2. <br /> <br />Organization of the Commission. <br /> <br />The ethics review commission each year shall elect from <br />its membership its chairperson and upon its formation <br />shall promulgate its own rules and regulations as to its <br />forms and procedures and maintain proper records of its <br />opinions and proceedings. <br /> <br />SECTION 3. Authority and Duties of the Ethics Review Commission. <br /> <br />The ethics review commission shall act as authorized by <br />Section 12.02 of the Charter of the City of San Marcos <br />concerning conflicts of interest, ethical conduct or <br />interests of city officials and employees. <br /> <br />A. The commission shall meet at least once a year <br />to review this chapter and may make recommendations <br />to the city council. <br /> <br />B. The commission shall conduct hearings into allegations <br />of violations of this chapter. <br /> <br />I <br /> <br />(1) Any allegation by any citizen, public <br />official or employee that a person has <br />violatec the code may be referred to any <br />member of the cor:unission. <br /> <br />(2) A commission member receiving an allegation <br />pursuant to Section 3 (B) may request the <br />commission to convene to review the allega- <br />tion. <br /> <br />(3) The commission shall recommend to appropriate <br />authorities cases for prosecution. <br />
