I I AN ORDINANCE OF THE CITY OF SAN MARCOS, TEXAS, REPEALING THE SUBDIVISION ORDINANCE OF THE CITY OF SAN MARCOS, TEXAS, CODIFIED AS APPENDIX C OF THE CODE OF ORDINANCES OF THE CITY OF SAN MARCOS, TEXAS, AND ENACTING A NEW ORDINANCE TO BE CODIFIED AS APPENDIX C OF SAID CODE ADOPTING AND PROMULGATING RULES AND REGULATIONS GOVERNING THE PLATTING OF LAND INTO SUBDIVISIONS IN THE CITY OF SAN MARCOS AND WITHIN THE EXTRATERRITORIAL JURISDICTION OF THE CITY SAN MARCOS AND REQUIRING PLATS TO CONFORM TO SUCH RULES AND REGULATIONS IN ORDER TO PROCURE THE APPROVAL OF THE CITY PLANNING AND ZONING COMMISSION OF THE CITY OF SAN MARCOS; DEFINING TERMS; FORBIDDING TRANSFERS OF LAND WITHOUT COMPLYING WITH THE TERMS OF THIS ORDINANCE; PROVIDING FOR VARIANCES FROM THE PROVISIONS OF THIS ORDINANCE; PROVIDING FOR THE APPEAL OF THIS ORDINANCE; PROVIDING PENALTIES FOR THE VIOLATION OF ANY OF THE PROVISIONS OF THIS ORDINANCE; PROVIDING FOR THE EFFECTIVE DATE; AND PROVIDING FOR THE STUDY AND PASSAGE OF THE ORDINANCE. . BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS. TEXAS. AS FOLLOWS: ARTICLE I. GENERAL PROVISIONS AND REQUIREMENTS SECTION A. Title Thi s Ordi nance shall be known, cited, and referred to as liThe City of San Marcos Subdivision Ordinance". SECTION B. Authority This Ordinance is adopted under the authority of the Constitution and laws of the State of Texas, including particularly Chapter 231, Acts of the 40th Legislature, Regular Session, 1927, as heretofore or hereafter amended (compiled as Article 974a, Vernon's Revised Civil Statutes), and the provi- sions of Section 4 of the Municipal Annexation Act as heretofore or hereafter amended (compiled as Article 970a, Vernon's Revised Civil Statutes). This Ordinance is adopted pursuant to the provisions of Section 12.10 and 7.05d of the Charter of the City. SECTION C. Purpose In order to achieve orderly, efficient and environmentally sound subdivision of land, the City of San Marcos must be provided with appropriate guidelines and mechanisms. This Subdivision Ordinance, in conjunction with any other land use control tool as now or hereafter may be adopted by the City, provides those guidelines and mechanisms. With this in mind, it is the nature, intent, and stated purpose of this Subdivision Ordinance to: 1. Provide for the most orderly, efficient and economical development of its residential, commercial and industrial land uses and community facilities to include transportation, water, sewerage, drainage, schools, parks, recreation, and any other related element. 2. Guide and phase any and all developments to maximize the utilization of existing and proposed public improvements. -1-
