<br />I <br /> <br />I <br /> <br />3. Guide and regulate the financial impact of new development on municipal <br />facilities. services, and capabilities. <br /> <br />4. Insure that the comprehensive and coordinated plans affected by the <br />various land use controls of the City are not negated by disorganized, <br />unplanned and uncoordinated development which would create an undue <br />burden and hardship on the ability of the community to translate the <br />development into reality. <br /> <br />5. <br /> <br />Establish and maintain municipal control over the character of develop- <br />ment and the quality of community facilities and services. <br /> <br />6. <br /> <br />Aid in establishing and maintaining a desirable degree of balance <br />among the uses of land. <br /> <br />7. Enhance the community aesthetically and to preserve and improve the <br />quality of life within the community. <br /> <br />SECTION D. Jurisdiction <br /> <br />From and after the date of its adoption, this Ordinance shall govern all <br />subdivisions of land within the corporate limits of the City of San Marcos <br />and within a distance of one (1) mile, subject to the laws of the State of <br />Texas. In the event that the distance from the city limits is changed by <br />the Texas Legislature, such distance provided for (by) this Ordinance shall <br />thereafter conform to the distance provided by the Legislature. <br /> <br />ARTICLE II. <br />DEFINITIONS <br /> <br />SECTION A. General <br /> <br />For the purposes of this Ordinance, the following terms, phrases, words, <br />and their derivations shall have the meaning ascribed to them in this <br />Article. Any office referred to in this Ordinance by title means the <br />person employed or appointed by the City in that position, or his duly <br />authorized representative. Definitions not expressly prescribed herein are <br />to be construed in accordance with customary usage in municipal planning <br />and engineering practices. <br /> <br />SECTION B. Definitions <br /> <br />1. ~: A minor public right-of-way, not intended to provide the <br />primary means of access to abutting lots, which is used primarily for <br />vehicular service access to the back or sides of properties otherwise <br />abutting on a street. <br /> <br />2. Building Setback Line: A line defining an area on the building lot <br />between the street right-of-way line and the building line within <br />which no building shall be constructed, encroach or project except as <br />specifically authorized in an adopted ordinance of the City of San <br />Marcos. <br /> <br />-2- <br />
