<br />SECTION IS - COMMERCIAL DISTRICT "C" <br /> <br />A. Permi tted Uses <br /> <br />In a "C" Commercial District no land shall be used and no building <br />shall be erected or converted to any other use than the following: <br /> <br />1. Any use permitted in any of the foregoing districts, excluding <br />the conditional uses listed in B below. <br /> <br />2. <br /> <br />Any other retail use provided such use is not noxious or offensive <br />by reason of the emission of odors, dust, noise, gas, fumes, <br />vibrations, soot, including any wholesale distributing or other <br />usage not listed under "I" (Section 21). <br /> <br />I <br /> <br />B. Specific Uses (Requires a Use Permit) (See Section 22) <br /> <br />1. Shopping Centers over 3 acres in size. <br /> <br />2. A mobile home on an unsubdivided tract or accessory to permitted <br />use for security and/or office purpose. <br /> <br />3. Bars and nightclubs in accordance with the adopted ordinances of <br />the City of San Marcos requiring a conditional use permit. <br /> <br />C. Prohibited Uses <br /> <br />1. Any building erected or land used for other than one or more of <br />the preceding specified uses. <br /> <br />2. Any use of property that does not meet the required mlnlmum lot <br />size; front, side and rear yard dimension; and/or lot width; or <br />exceeds the maximum height. building coverage or density per <br />gross acre as required. <br /> <br />1. Minimum depth of rear setback shall be five <br />feet with an additional two feet required for <br />each story above 24 feet, up to a maximum setback <br />of 25 feet. There shall be no encroachment or <br />overhangs into this required rear yard. <br /> <br />6. <br /> <br />Minimum width of side setback <br />a. Internal lot <br />b. Townhouses shall meet the area requirements <br />of the "TH" District. <br /> <br />11.
