Mr. Jones inquired as to the complaints <br />they received on vehicles in the grass in homeowners' yards. Carol Barrett, <br />Director of Planning and Development, stated the City Council, Planning and <br />Zoning Commission and the Planning and Zoning Commission Subcommittees, <br />received complaints regarding vehicles in homeowners front yards. She <br />stated Code Enforcement took pictures, and the majority of complaints <br />involved motor vehicles. Mr. O'Leary stated most complaints Staff received <br />were because of devaluation of property in the area. Mr. Jones moved to <br />Section 82.185, Exceptions, to exclude motor vehicles. There was no second <br />and the motion failed. The Council then voted unanimously for approval of <br />the Ordinance on first reading. <br /> <br />Mayor Narvaiz introduced for consideration a public hearing and approval of <br />an Ordinance on first reading, the caption which was read as follows: <br /> <br />I <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />DESIGNATING A 15-ACRE AREA WITHIN THE CITY AT THE INTERSECTION OF IH35 <br />SOUTH AND MCCARTY LANE AS TAX INCREMENT FINANCING REINVESTMENT ZONE <br />NO. 3 PURSUANT TO CHAPTER 311 OF THE TEXAS TAX CODE; CREATING A BOARD <br />OF DIRECTORS FOR THE ZONE; CONTAINING FINDINGS; AND INCLUDING <br />PROCEDURAL PROVISIONS. <br /> <br />Mayor Narvaiz opened the public hearing and asked if anyone wished to <br />speak. No one did, so Mayor Narvaiz closed the public hearing. Mr. Bose <br />moved for approval of the Ordinance on first reading, and Mr. Guerrero <br />seconded the motion. Mr. Bose inquired whether San Marcos School District <br />was participating in the TIRZ No.3. Mr. O'Leary stated the SMCISD is not <br />participating in the TIRZ NO.3. Mr. Taylor stated State Law requires a <br />seat for each taxing entity. He stated there are mechanisms in the <br />Ordinance for the SMCISD to waive their seat on the board.
