184. <br />Regular Meeting March 7, 2006 Page 5 <br />TO PROVIDE FOR A MORE INCLUSIVE DEFINITION OF JUNKED VEHICLE; <br />INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. <br />Mayor Narvaiz stated a citizen has signed up to speak on this item. Sherri <br />Bilson stated she is grateful for getting junk cars off neighborhood <br />properties. She thanked Ken Bell and his Staff for all their hard work. <br />Mr. Mihalkanin moved for approval of the ordinance on second reading, and <br />Mr. Jones seconded the motion. Mr. Mihalkanin inquired as to the <br />clarification regarding boats with covers parked in driveways. Jan Clark, <br />Assistant City Attorney, stated if a boat is covered and parked in the <br />driveway, then the property owner will not be ticketed. Mr. Mihalkanin <br />inquired if a boat owner who was leaving early to go fishing parked their <br />vehicle with a boat attached on the street, would the owner be ticketed. <br />Ms. Clark stated the boat owner would not be ticketed, since it would be <br />parked there less than 24 hours. Mr. Jones stated if a resident is not <br />allowed to park on the street and there is not enough parking in the <br />driveway, where is the resident allowed to park. Carol Barrett, Director <br />of Planning and Development, stated the Code allows for a paved driveway <br />not to exceed 42% of the yard. Mr. Jones inquired as to the number of <br />hours spent to enforce and to make citizens aware of the Code updates. Ms. <br />Barrett stated she feels citizens can be updated by getting the word to the <br />public through the website, television, word of mouth and warning. She <br />stated she feels overtime would be determined on how much the public <br />understands the amended Ordinance. The Council then voted unanimously for <br />approval of the Ordinance on second reading. <br />Mayor Narvaiz introduced for consideration Item 12, removed from the <br />consent agenda, approval of an ordinance on second reading, the caption <br />which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING ARTICLE 2 OF THE CODE OF ORDINANCES BY ADDING SECTIONS 2.545 <br />AND 2.546 TO ESTABLISH A MUNICIPAL COURT SECURITY FEE AND CREATE A <br />MUNICIPAL COURT SECURITY FUND, AND SETTING THE AMOUNT OF THE MUNICIPAL <br />COURT SECURITY FEE; AND INCLUDING PROCEDURAL PROVISIONS. <br />Mr. Guerrero moved for approval of the ordinance on second reading, and Mr. <br />Jones seconded the motion. Mr. Jones inquired whether there will be enough <br />funds collected from Class C misdemeanor convictions to pay for the <br />Municipal Court security. Mr. O'Leary stated there will be a $3.00 <br />security court fee added to all Class C misdemeanor offenses, which should <br />be enough to cover the cost of security. On roll call the following vote <br />was recorded: <br />AYE: Thomaides, Guerrero, Mihalkanin, Narvaiz, Diaz and Bose. <br />NAY: Jones.
