186. <br />Regular Meeting March 7, 2006 Page 7 <br />staff has negotiated with Broaddus to determine the proposal scope and to <br />identify tasks that can be handled in-house or by the project architect, <br />and it is probable that the eventual cost will be less than the maximum <br />amount. He stated the eventual cost will be calculated as part of the <br />City's original $20 million commitment to the Conference Center project. <br />Mr. Bose inquired as to the contract proposing to have three full time <br />employees on site from groundbreaking to the end of the project. Jim <br />Broaddus, owner of Broaddus and Associates, Inc., stated this proposed <br />contract is to manage the project, which includes reviewing the design, <br />making sure the construction is being done in code compliance, and to <br />protect the City's interest to ensure a fair price. He stated they will be <br />charging services on an hourly rate, not to exceed $482,400.00. Mr. Diaz <br />inquired as to the risk. Mr. Broaddus stated this contract will reduce the <br />risk of going over budget and will make sure the City gets what they want <br />out of the project. On roll call the following vote was recorded: <br />AYE: Thomaides, Guerrero, Narvaiz, Diaz, Jones and Bose. <br />NAY: Mihalkanin. <br />ABSTAIN: None. <br />Mayor Narvaiz introduced for consideration Item 22, removed from the <br />consent agenda, adoption of a Resolution, the caption which was read as <br />follows: <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AUTHORIZING THE ISSUANCE OF A PURCHASE ORDER FOR THE CONSTRUCTION OF <br />THE BANKS PORTION OF THE RIO VISTA DAM MAINTENANCE AND WHITEWATER <br />IMPROVEMENTS PROJECT TO GREENWAY ENTERPRISES, INC. THROUGH THE <br />COOPERATIVE PURCHASING NETWORK; AUTHORIZING THE PURCHASING MANAGER TO <br />EXECUTE THE APPROPRIATE PURCHASING DOCUMENTS ON BEHALF OF THE CITY; <br />AND DECLARING AN EFFECTIVE DATE. <br />Mr. Jones moved for adoption of the Resolution, and Mr. Guerrero seconded <br />the motion. Mr. O'Leary stated the City is using the Texas Cooperative <br />Purchasing Network to purchase construction services for the embankment <br />work associated with Rio Vista Dam Maintenance and Whitewater Improvements. <br />He stated Greenway, Inc. was the low bidder for these services in our area. <br />The TCPN is typically used for the construction of building facilities, but <br />is being used for this purpose because it allows the contractor to actively <br />participate in the design process. He stated Greenway will be removing the <br />existing retaining walls on the right bank and re-grading the park area on <br />the right bank to mitigate the additional material added to the river with <br />the whitewater improvements. Mr. Guerrero inquired as to the lower flow of <br />the river. Rodney Cobb, Director of Parks Department, stated the river is <br />flowing at less than 130 cubic square feet.
