He stated the CUP process was on the books before the legislation. I <br />Mr. Jones inquired as to the number of times a Police Officer visits the <br />bars in Downtown and Bum's. Chief Williams stated the bars in San Marcos <br />are visited on a regular basis. He stated the Downtown bars are visited <br />more often to catch under age drinking. Mr. Mihalkanin inquired whether <br />the Police Department communicated with Bumb's regarding these incidents. <br />Chief Williams stated the Police Department has held several conversations <br />with Bum's and no action was ever taken by the owner. Mr. Mihalkanin <br />inquired whether names and photos of the offenders were provided to Bumb's. <br />Chief Williams stated several discussions were held with Bum's where names <br />and photos were provided. He stated Bum's was informed to ask the <br />offenders to stay out of their business. Mr. Bose moved to amend Part 1 to <br />read. . the City Council sustains the assessment of two penalty points <br />. and this assessment is supported by the preponderance of the credible <br />evidence, and Mr. Thomaides seconded the motion. On roll call for the <br />support of Part 1, the following vote was recorded: <br /> <br />AYE: <br /> <br />Thomaides, Guerrero, Mihalkanin, Narvaiz, Diaz and Bose. <br /> <br />NAY: <br /> <br />Jones. <br /> <br />ABSTAIN: None. <br /> <br />Mr. Guerrero moved to amend Part 2 to read. . . the City Council sustains II <br />the assessment of two penalty points . . . and this assessment is supported <br />by the preponderance of the credible evidence, and Mr. Diaz seconded the <br />motion, which passed unanimously.
