This <br />means Centerpoint cannot increase its base rates on account of (a) <br />inflation or escalation in the cost of goods or services; (b) hurricanes <br />weather events; (c) escalation in the cost of labor or benefits; or (d) <br />increase in the cost of the installation, relocation or replacement of <br />pipes. 3. After the expiration of the rate freeze, Centerpoint can only <br />raise base rates if it first files with the ACM Cities. CenterPoint will <br />not file at the Railroad Commission for a rate increase in the <br />unincorporated areas before it files with the ACM Cities. 4. CenterPoint <br />will not be allowed to file a general rate case without publishing notice <br />in a specific, conspicuous manner described in the Settlement Agreement. 5. <br />The rate case related expenses of CenterPoint, and the expenses of <br />attorneys and consultants for the ACM Cities will be borne by CenterPoint <br />shareholders. This means that none of these costs will be borne by <br />Centerpoint ratepayers. 6. CenterPoint has agreed to pay the ACM Cities <br />the sum of $414,000.00 for "other claims". This sum will be borne by <br />CenterPoint shareholders, and will be distributed to the ACM Cities to be <br />used as directed by the individual cities for the benefit of their <br />citizens. He stated San Marcos will be receiving about $19,000.00 as part <br />of the settlement. Mr. Jones stated if the City opposes this settlement, <br />then the cost would be more. He stated he is disappointed with CenterPoint <br />and feels they did an injustice to the citizens. Mayor Narvaiz stated she <br />agreed with Mr. Jones. She thanked the Staff for their hard work on this <br />case. She stated she would like for Council to consider placing the <br />$19,000.00 settlement from Centerpoint in a fund to help people who are <br />unable to pay utility bills.
