Carol Barrett, Director of <br />Planning and Development, stated the scope of the current proposed study is <br />to take comparable land in the surrounding cities and do a comparison cost <br />study to help balance the City's desire to encourage development while <br />protecting the environment and minimizing flooding hazards. She stated the <br />Planning and Development Department does not get much request for mixed use <br />zoning, Mr. Jones stated he feels the Home Builders Association should <br />have an input in this study. He also stated he is not comfortable with <br />Dunkin, Sefko conducting the study. He stated he wants the Code really <br />scrutinized. Mr. Thomaides stated he hopes the report really tells the <br />Council what they want to know. He stated he is also concerned with the <br />high price the consultants are charging, since they originally helped <br />develop the Code. Mr. Bose stated he feels San Marcos adopted a Land <br />Development Code to raise the standards for building to a higher standard <br />provide for quality of life for the future. Mayor Narvaiz stated she <br />agrees with Mr. Jones about whether Dunkin, Sefko can give an objective <br />critique of the Code since they drafted the Codes in New Braunfels and San <br />Marcos. Mr. Jones inquired whether this contract should go out for bid. <br />Mr. Taylor stated the State Law does not require competitive bidding on a <br />professional contract, but the City Manager requires proposals. Mr. <br />Guerrero inquired as to how many other firms were considered. Ms. Barrett <br />stated she had informal communications with other consulting firms <br />I regarding cost. She stated she feels the cost of this study would be much <br />lower since this firm is already familiar with the Land Development Code. <br />Mr. O'Leary stated the study is to find out whether or not San Marcos is <br />competitive with other surrounding cities. He stated he feels this is the <br />best price for this study. Mr. Mihalkanin stated he is comfortable with <br />this firm conducting study and feels this is a fair price for this type of <br />study. On roll call for adoption of the Resolution, the following vote was <br />recorded: <br /> <br />AYE: Thomaides, Guerrero, Mihalkanin, Narvaiz, Diaz and Jones. <br /> <br />NAY: Bose. <br /> <br />ABSTAIN: None. <br /> <br />Mayor Narvaiz introduced for consideration Item 20, removed from the <br />consent agenda, adoption of a Resolution, the caption which was read as <br />follows: <br /> <br />1 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AUTHORIZING THE SUBMISSION OF A GRANT APPLICATION TO THE TEXAS <br />DEPARTMENT OF TRANSPORTATION ("TXDOT") FOR FY 2006/2007 AND FY <br />2007/2008 CAPITAL IMPROVEMENT PROGRAM ("CIP") GRANT FUNDING; APPROVING <br />THE CITY'S EXPENDITURE OF LOCAL MATCHING FUNDS CONTINGENT UPON THE <br />
