132 <br />Regular Meeting August 15, 2006 Page 9 <br />Mr. Diaz moved for adoption of the Resolution, and Mr. Jones seconded the <br />motion. Mr. O'Leary stated staff used a new process which allowed more <br />flexibility than the normal process. He stated seven firms responded to <br />the Design/Build process. A committee of ten evaluators ranked the firms' <br />qualifications and the top two firms were invited to submit proposals in <br />response to RFP issued by the City. He stated the proposals were received <br />on June 15, 2006, and respondents were interviewed on June 21, 2006. The <br />committee ranked Flintco, Inc. as the best firm for this project. He <br />stated while this contract covers the full design build scope, <br />authorization for construction for the Conference Center will occur after <br />the Guaranteed Maximum Price (GMP) has been accepted and a Notice to <br />Proceed has been issued by the City Council. The design build contract <br />provides the City the option to not proceed with construction if an <br />acceptable GMP cannot be reached. If this should occur, the City will only <br />be responsible for the Pre-construction Phase Services identified at <br />$75,000.00. On roll call for adoption of the Resolution, the following <br />vote was recorded: <br />AYE: Thomaides, Guerrero, Narvaiz, Diaz, Jones and Bose. <br />NAY: Mihalkanin <br />ABSTAIN: None. <br />Mayor Narvaiz introduced for consideration approval of one appointment to <br />the Beautification Commission. Mr. Guerrero moved to appoint Tina Cade. <br />Mr. Mihalkanin stated this appointment is to fill a vacancy for the Texas <br />State University appointment and he would be abstaining from this vote. On <br />roll call the following vote was recorded: <br />AYE: Thomaides, Guerrero, Narvaiz, Diaz, Jones and Bose. <br />NAY: None. <br />ABSTAIN: Mihalkanin. <br />Mayor Narvaiz introduced for consideration a public hearing and approval of <br />an Ordinance on first reading, the caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />UPDATING AND AMENDING THE CITY LAND DEVELOPMENT CODE, INCLUDING <br />PROVISIONS RELATED TO WATERSHED PROTECTION PLANS, TRAFFIC IMPACT <br />ANALYSES, ASSIGNMENT OF NEW USES TO ZONING DISTRICTS, BUILDING <br />EXTERIOR DESIGN AND MATERIALS, OFF-STREET PARKING, EXTERIOR LIGHTING, <br />AND FENCES; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR <br />PENALTIES.
