Mr. Jones <br />moved for approval of the Ordinance on first reading, and Mr. Thomaides <br />seconded the motion. Mr. Thomaides inquired about the proposed revisions <br />to the Land Development Code. Carol Barrett, Director of Planning <br />Department, stated the proposed revisions will make the City's regulations <br />and processes more user-friendly and easier to understand. She stated most <br />of the revisions for are for clarification and are clerical in nature. She <br />also stated the revisions are to help reduce the number of requests for <br />variances. Mr. Jones thanked Ms. Barrett for listening to the community. <br />Mayor Narvaiz inquired as to whether developers still have the option to <br />request a variance if needed. Ms. Barrett stated they could still be <br />requested. Mr. Thomaides moved to amend Section 4.2.2.3(a) to read. . . <br />businesses shall use landscaping and other buffering techniques to <br />minimize their impact on the adjacent community, and Mr. Bose seconded the <br />motion, which passed unanimously. The Council then voted unanimously for <br />approval of the Ordinance on first reading. <br />Mayor Narvaiz introduced for consideration a public hearing and approval of <br />an Ordinance on first reading, the caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />INCREASING THE RATES FOR DRAINAGE UTILITY SERVICES; INCLUDING <br />PROCEDURAL PROVISIONS; AND PROVIDING FOR REMEDIES FOR NONPAYMENT. <br />Mayor Narvaiz opened the public hearing and asked if anyone wished to <br />speak. Mr. O'Leary stated the Council directed <br />staff to increase drainage utility rates by 23.5% in order to address the <br />high priority need for additional maintenance of existing drainage <br />facilities, as well as increase the ability to fund additional drainage <br />capital improvement projects. The Drainage Utility rates have not been <br />increased since they were implemented in FY 2000. He stated the average <br />resident lot size will increase monthly by .754. Mr. Guerrero inquired to <br />the number of times a year drainage ditches are cleaned. Mr. O'Leary <br />stated currently they are cleaned three times per year. The Council agreed <br />with the current process staff uses to review drainage concerns and asked <br />staff to provide information about the situation involving the Allen Wood <br />Homes drainage ditch. The Council then voted unanimously for adoption of <br />the Resolution. <br />Mayor Narvaiz introduced for consideration and approval to accept the <br />resignation of Council Member, Place One, Ed Mihalkanin (resignation <br />effective upon his successor being duly qualified).
